ORDINANCE NO. 071130

Repealing the November 2006 light rail ordinance, Ordinance No. 060931, As Amended.

WHEREAS, Ordinance No. 060931, As Amended, was presented to the voters as a result of an initiative petition; and

WHEREAS, since the adoption of the ordinance the City and the Kansas City Area Transportation Authority has conducted the studies necessary to determine the viability of the plan the initiated ordinance proposes; and

WHEREAS, the November 2006 light rail plan cannot be constructed, maintained and operated as provided in the plan; and

WHEREAS, the City and the Kansas City Area Transportation Authority are in the process of preparing the necessary applications to seek federal financial assistance; and

WHEREAS, the City and the Kansas City Area Transportation Authority must establish a realistic light rail plan that can be lawfully constructed, maintained and operated within realistic financial limits; and

WHEREAS, the existence of a plan that cannot be constructed, maintained, and operated within the budget provided by the initiative adopted in November 2006 impairs the ability of the City and the Kansas City Area Transportation Authority to move expeditiously towards a realistic light rail plan and towards competing for federal transit funds; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. Repeal of November 2006 light rail plan. That Ordinance No. 060931, As Amended is repealed.
