ORDINANCE NO. 980268

 

Condemning and taking private property in fee for public use for Brooklyn West and Independence Plaza Urban Renewal Area; providing for the payment of just compensation; and authorizing negotiations by the Director of City Development.

 

WHEREAS, the Council finds and determines it necessary to condemn and acquire fee simple title to the private property hereinafter described which is generally located between 13th Street, 14th Street, Garfield Avenue, and Park Avenue, located in Kansas City, Jackson County, Missouri; and

 

WHEREAS, the City Council has, by ordinance, declared the areas in which the properties hereinafter described are located to be blighted, substandard or insanitary and suitable for redevelopment; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the following tracts of land are hereby condemned and taken in fee simple for public use for the 12th Street Heritage Housing Development Project generally located at 14th and Brooklyn Streets, and said tracts are legally described as follows:

 

Tract 9: Lots 18, 19 and 20, Block 1, Floral Place, a subdivision lying in Kansas City, Jackson County, Missouri.

 

Tract 10: Lot 17, and the north half of Lot 16, Block 1, Floral Place, a subdivision lying in Kansas City, Jackson County, Missouri.

 

Tract 3: Lot 5, Wilsons Subdivision of a part of Lot 8 of William Proctor McElroys Subdivision, a subdivision lying in Kansas City, Jackson County, Missouri.

 

Tract 5: The north 27 3/4 feet of Lot 24, Block 1, Floral Place, a subdivision lying in Kansas City, Jackson County, Missouri.

 

Tract 7: Lot 22, Block 1, Floral Place, a subdivision lying in Kansas City, Jackson County, Missouri.

 

Tract 2: The west 38 feet of the east 93 feet of Lots 7, 8 and 9, Bend Place, a subdivision lying in Kansas City, Jackson County, Missouri.

 

Tract 12: The west 51.5 feet of Lots 13 and 14, Block 1, Floral Place, a subdivision lying in Kansas City, Jackson County, Missouri.

 

Tract 13: The west 38 feet of the east 82.5 feet of Lots 13 and 14, Block 1, Floral Place, a subdivision lying in Kansas City, Jackson County, Missouri.

Tract 4: All of Lot 6, Wilsons Subdivision of part of Lot 8 of William Proctor McElroys Subdivision, a subdivision lying in Kansas City, Jackson County, Missouri.

 


Tract 8: Lot 21, Block 1, Floral Place, a subdivision lying in Kansas City, Jackson County, Missouri.

 

Section 2. Just compensation for the tracts of land taken or damaged herein shall be assessed and paid according to law. Payment for such compensation or damages shall be made by Kansas City in cash from funds appropriated for said purposes; and the proceedings for taking or damage in the aforesaid property shall be instituted in the first instance and prosecuted in the Circuit Court of Jackson County, Missouri at Kansas City, either pursuant to the provisions of Chapter 523 of the Revised Statutes of Missouri, 1959, as supplemented or amended by Sections 86.10 of the Rules of Civil Procedures.

 

Section 3. Pending the acquisition of said lands by condemnation, the Director of City Development is hereby authorized to purchase said land out of funds appropriated or to be appropriated as aforesaid, and if any tracts be so acquired by purchase, the City Attorney is authorized to withdraw same from condemnation proceedings.
