COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 961558

 

Repealing Sections 2-825, Election of members--Nominations, 2-826, Same--Conduct of elections, 2-828, Meetings, 2-831, Finances, and 2-832, Staff of the Code of Ordinances relating to the Silver Haired City Council, and enacting new sections of like number and subject in lieu thereof.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Section 2-825, Election of members--Nominations, of the Code of Ordinances is hereby repealed and a new Section 2-825 is hereby adopted, to read as follows:

 

Sec. 2-825. Election of members--Nominations.

 

Nominating petition forms for elections under this division will be furnished by the City Clerk. Nominations may be made by petition delivered to the City Clerk not less than 45 days before the election. Petitions must be signed by 25 registered voters of this city who are 60 years of age or older and who reside in the district in which the candidate resides. Eligible voters may sign one petition for each of two candidates for office in the district in which the voter resides.

 

Section 2. That Section 2-826, Same--Conduct of elections, of the Code of Ordinances is hereby repealed and a new Section 2-826 is hereby adopted, to read as follows:

 

Sec. 2-826. Same--Conduct of elections.

 

(a) The office of the City Clerk shall conduct the election of members of the silver haired city council and shall have the following duties:

 

(1) The preparation, printing the candidates name listed in the order of filing and distribution of ballots and affirmation forms.

 

(2) The designation of the election date and polling hours. The polling hours shall be equal in number at all polling places, but need not be identical.

 

(3) The designation of an equal number, not less than three and not more than five, of polling places per district.

 

(4) The publication of the list of candidates along with the date, time and place of the election by release of such information to the news media not less than ten days before

the election.

 

(5) The supervision of the polling places.

 

(6) The collection of the ballots.

 

(7) The canvass of ballots, tabulation and certification of results and disposition of ballots.

 

(b) Each voter shall be entitled to vote for two candidates in the district in which the voter resides.

 

(c) The two candidates in each district receiving the greatest number of votes shall be deemed elected. The silver haired city council and the City Clerk shall make provisions for runoff elections in the event of a tie.

 

(d) Costs of elections conducted under this division shall be budgeted and paid as part of the budget for the silver haired city council, to be included as a separate budgetary account in the office of the City Clerk.

 

(e) The silver haired city council may provide volunteers to staff the polling places and to assist the City Clerk in conducting silver haired city council elections.

 

(f) Electioneering, distributing election literature, posting signs or parking or operating vehicles bearing signs with respect to any candidate shall be prohibited on election day inside any building at which a polling place is located or within 25 feet of such building's outer door closest to the polling place.

 

(g) Absentee ballots and affirmation forms shall be mailed to eligible voters upon written request to the City Clerk. Completed absentee ballots shall be returned to the City Clerk on or before 5:00 p.m. on the working day prior to the day of the election. Each ballot must be accompanied by an executed affirmation form; otherwise the ballot shall not be counted.

 

(h) If there is only one candidate for any position on the silver haired city council, an election for that position shall not be necessary and the sole candidate shall be declared elected. If there is no candidate for a position on the silver haired city council, that position shall be filled by appointment according to rules adopted by the silver haired city council.

 

Section 3. That Section 2-828, Meetings, of the Code of Ordinances is hereby repealed and a new Section 2-828 is hereby adopted, to read as follows:

 

Sec. 2-828. Meetings.

 

The silver haired city council shall convene legislative sessions no more than quarterly or upon call of the majority of the elected membership. Legislative meetings upon call shall be initiated by petition to the City Clerk submitted at least ten days in advance of such called legislative session.

 

Section 4. That Section 2-829, Mayor pro tem; committees, of the Code of Ordinances is hereby repealed and a new Section 2-829 is hereby adopted, to read as follows:

 

Sec. 2-829. Mayor pro tem; committees.

 

(a) The silver haired city council shall elect from its membership a mayor pro tem at the first meeting of the silver haired city council after the silver haired city council election. The mayor pro tem shall preside over the silver haired city council sessions. In the event of the absence of the mayor pro tem, the silver haired city council shall select an acting mayor pro tem.

 

(b) The silver haired city council shall elect a committee of five of its members to serve as a policy and rules committee. The mayor pro tem shall appoint members to standing council committees similar to those of the city council.

 

(c) The silver haired city council, by resolution, may establish special committees. The mayor pro tem shall appoint the members and chairpersons of these committees.

 

Section 5. That Section 2-831, Finances, of the Code of Ordinances is hereby repealed and a new Section 2-831 is hereby adopted, to read as follows:

 

Sec. 2-831. Finances.

 

The City Clerk is hereby designated as the requisitioning authority for the funds of the silver haired city council. The director of finance is the custodian of the silver haired city council fund. The silver haired city council may request approval of an annual budget for administrative expense to be submitted to the council by the City Clerk and to be included as a separate budgetary account in the City Clerk's annual budget request.

 

Section 6. That Section 2-832, Staff, of the Code of Ordinances is hereby repealed and a new Section 2-832 is hereby adopted, to read as follows:

 

Sec. 2-832. Staff.

 

The office of the City Clerk shall provide clerical and administrative services for the silver haired city council.
