ORDINANCE NO. 030489
Approving
an amendment to a previously approved preliminary plan in District PD/RA, R-4-O
(Planned District/Agricultural, Low Apartments) on approximately a 36 acre
tract of land generally located on the east side of Wornall Road approximately
180 feet south of Martha Truman Road, for the purpose of deleting an
approximately 8 acre tract of land from said preliminary plan and allowing a
church, elementary school and offices. (4031-PD-11)
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That an amendment to a previously approved preliminary plan in District
PD/RA, R-4-O (Planned District/Agricultural, Low Apartments) on approximately a
36 acre tract of land generally located on the east side of Wornall Road
approximately 180 feet south of Martha Truman Road, and more specifically
described as follows:
All of Lots 1 and 2, NOMDA Center, a subdivision
in Kansas City, Jackson County, Missouri.
for
the purpose of deleting therefrom an approximately 8 acre tract of land, more
specifically described as follows:
All of Lot 2, NOMDA Center, a subdivision in
Kansas City, Jackson County, Missouri.
so
that the remaining tract of land of approximately 28 acres, more specifically
described as follows:
All of Lot 1, NOMDA Center, a subdivision in
Kansas City, Jackson County, Missouri.
and
for the purpose of allowing a church, elementary school and offices to be
constructed, is hereby approved, subject to the following conditions:
1. That
the developer widen the east side of Wornall Road to provide a 20 feet long
northbound right turn lane with 150 feet long taper as required by the
Department of Public Works prior to a certificate of occupancy for the church.
2. That
the developer widen Wornall Road to provide a 150 feet long southbound left
turn lane with taper as required by the Department of Public Works prior to a
certificate of occupancy for the church.
3. That
the developer enter into a cooperative agreement with the City as required by
the Department of Public Works whereby the developer agrees to terminate the
existing agreement and to contribute $14.00 per foot for 960 feet for a total
of $13,440.00 for construction of sidewalks and curbs along Wornall Road prior
to the
issuance
of a certificate of occupancy for the church.
4. That the developer receive
approval of a final plan by the City Plan Commission for widening of the
existing drive and any sign modifications prior to issuance of a certificate of
occupancy.
A copy of said amendment is
on file in the office of the City Clerk under Document No. 030489, which is
attached hereto and made a part hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
