COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 960588
Amending Chapter 65, Revised Ordinances of Kansas City,
Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section
to be known as Section 65.010A2653, rezoning an area of approximately 3.9 acres
generally located at 10700 Hickman Mills Drive from District CP-2 (Local
Planned Business Center) to District CP-3 (Regional Planned Business Center),
and approving a preliminary plan for the same. (8049-CP-1)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That Chapter 65, Revised Ordinances of
Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby
amended by enacting a new section to be known as Section 65.010A2653, rezoning
an area of approximately 3.9 acres generally located at 10700 Hickman Mills
Drive from District CP-2 (Local Planned Business Center) to District CP-3
(Regional Planned Business Center), said section to read as follows:
Section 65.010A2653. That an area legally described
as:
Part of the South 1/2 of the Southeast 1/4 of
Section 35, Township 48, Range 33, and part of the Northeast 1/4 of
Section 2, Township 47, Range 33, in Kansas City, Jackson County,
Missouri, described as follows: Beginning at the intersection of the
westerly line of Hickman Mills Drive (formerly U.S. Highway No. 71) with a line
that is 247.64 feet south of and parallel with the north line of the
Northeast 1/4 of said Section 2, as measured along the east line of said
1/4 Section; thence North 3 29'00" West along the westerly line of
said Hickman Mills Drive, a distance of 27.88 feet; thence in a
northwesterly direction along said westerly line and along a curve to the
left having a radius of 1116.3 feet and the last described course as a tangent,
an arc distance of 474.09 feet; thence North 27 49'00" West along
said westerly line and tangent to the last described course, a distance of
138.06 feet to the southeasterly line of Interstate Route 470; thence
South 55 59'00" West along said southeasterly line, a distance of
276.57 feet to its intersection with the easterly line of the St. Louis
and San Francisco Railroad; thence in a southeasterly direction along said
easterly line and along a curve to the right having a radius of 1465.31
feet and an initial tangent bearing of South 10 50'20" East an arc
distance of 55.26 feet; thence South 8 40'41" East along said
easterly line and tangent to the last described curve, a distance of
391.69 feet to a point on a line that is 247.64 feet south of and parallel
to the north line of said Northeast 1/4 Section; thence South 88
55'30" East along said parallel line, a distance of 353.89 feet to
the point of beginning.
is hereby rezoned from District CP-2 (Local Planned
Business Center) to District CP-3 (Regional Planned Business Center), all as
shown outlined on a map marked Section 65.010A2653, which is attached hereto
and made a part hereof, and which is hereby adopted as a part of an amendment
to the zoning maps constituting a part of said chapter and as an amendment to
Section 65.010 thereof.
Section B. That a preliminary plan for the area
legally described above is hereby approved, subject to the following
conditions:
1. That the developer provide fire protection as
required by the Fire Department.
2. That the developer enter into a deferral
agreement for the improvement of one-half of Hickman Mills Drive to
secondary arterial street standards, including construction
of sidewalks as required by the Department of
Public Works, installation of a steel
fence to replace the existing chain link fence
and installation of landscaping as
required by the Department of City Development
at such time as Hickman Mills Drive
is improved immediately to the north of the
site.
3. That the developer contribute $1,125.00 to the
I-435/I-470 Corridor Study for 88 truck parking spaces (2.499 trips x
$450.00).
4. That the developer submit a final plan to the
City Plan Commission for approval, including plans for landscaping
prior to the issuance of a building permit.
A copy of said preliminary plan is on file in the office
of the City Clerk under Document No. 960588, which is attached hereto and made
a part hereof.
Section C. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
