COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 961528

 

Approving a development plan in District GP-7 (Agricultural and Low Density Residential Uses) on approximately a 9.4 acre tract of land generally located at 11340 N.W. Prairie View Road. (5930-GP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a development plan in District GP-7 (Agricultural and Low Density Residential Uses) on approximately a 9.4 acre tract of land generally located at 11340 N.W. Prairie View Road, and more specifically described as follows:

 

A tract of land in the Southeast Quarter (1/4) of the Southwest Quarter (1/4) of Section 23, Township 52, Range 34, Kansas City, Platte County, Missouri, described as follows: Beginning at a point on the north line of the Southeast Quarter (1/4) of the Southwest Quarter (1/4) of Section 23, Township 52, Range 34, said point being 44.9 feet west of the northeast corner of the Southeast Quarter (1/4) of the Southwest Quarter (1/4) of Section 23, Township 52, Range 34, said point also being on the west right of way line of U.S. Highway No. 71; thence South 0 18'00" West along said west right of way line a distance of 516.3 feet; thence South 89 36'48" West a distance of 300 feet; thence South 0 18'00" West parallel with the said west right of way line a distance of 300 feet; thence South 89 36'48" West, a distance of 310.81 feet to a point on the west line of the East One-Half (1/2) of the Southeast Quarter (1/4) of the Southwest Quarter (1/4) of Section 23, Township 52, Range 34; thence North 0 01'02" East along said west line a distance of 816.3 feet to a point on the north line of the Southeast Quarter (1/4) of the Southwest Quarter (1/4) of said Section 23, said line also being the south line of Platte Gardens, a subdivision of land in Platte County, Missouri, according to the recorded plat thereof; thence North 89 36'48" East along said south line to the point of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer receive the approval of the Missouri Highway and Transportation Department prior to working in any State right of way.

 

2. That the developer secure the approval of the Missouri Highway and Transportation Department for the driveway access as shown on the development plan from Prairie

View Road.

 

3. That the developer design and install the communication tower to allow for co-location of an additional carrier.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 961528, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
