ORDINANCE NO. 130711

 

Accepting a United States Environmental Protection Agency Brownfields Coalition Assessment Grant in the amount of $600,000.00; estimating revenue in the amount of $600,000.00 in the Brownfields Fund; appropriating funds to certain accounts within the Brownfields Fund; designating requisitioning authority; authorizing the execution a Memorandum of Agreement with certain coalition partners; and authorizing further acts.

 

WHEREAS, as authorized by Resolution No. 120969, an application for a brownfields assessment coalition grant in the amount of $600,000.00 was submitted to the United States Environmental Protection Agency (“EPA”); and

 

WHEREAS, In November 2012, the Mayor, as well as authorized representatives of the Unified Government of Wyandotte County/Kansas City, Kansas and the Mid-America Regional Council, signed letters of intent to enter into a OneKC brownfields coalition to administer the grant; and

 

WHEREAS, EPA announced the selection of the OneKC brownfields coalition grant application for award in 2013; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Director of the Department of City Development is authorized to accept from EPA a brownfields coalition assessment grant for the assessment of hazardous waste and petroleum brownfield sites in Kansas City, Missouri and Kansas City, Kansas in the total amount of $600,000.00.

Section 2. That revenue in the following accounts of the Brownfields Fund are estimated in the following amounts:

14-2550-640001-476725 Brownfields Coalition Hazardous Substances $450,000.00

14-2550-640001-476726 Brownfields Coalition Petroleum 150,000.00

TOTAL $600,000.00

 

Section 3. That $600,000.00 is appropriated from the Unappropriated Fund Balance of the Brownfields Fund to the following accounts:

Haz Sub $ 35,100.00

14-2550-645020-G64COH1KC-B OneKC Brownfields Coalition

Haz Sub 414,900.00

14-2550-645020-G64COP1KC-B OneKC Brownfields Coalition

Petroleum 138,300.00

TOTAL $600,000.00

 

Section 4. That the Director of City Development is designated as requisitioning authority for Account No. 14-2550-645020.

Section 5. That the Director of City Development is authorized to enter into a Memorandum of Agreement the Unified Government of Wyandotte County/Kansas City, Kansas and the Mid-America Regional Council to formalize the coalition.

Section 6. That the Director of City Development is authorized to undertake any necessary further acts related to the grant award and coalition administration, all consistent with this ordinance.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
