COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 071195

 

Amending Chapter 2, Article II of the Code of Ordinances by repealing Section 2-52, Budget Process and enacting in its place a new section, establishing January 1 to December 31 as the fiscal year of the City and changing certain dates in the budget process to be consistent with the new fiscal year.

 

WHEREAS, Section 801 of Charter provides that, unless otherwise provided by the City Council, the fiscal year of the City shall be May 1 through April 30; and

 

WHEREAS, the Council desires to change the fiscal year to a calendar year basis; and

 

WHEREAS, certain sections of the Charter and Code specify dates for elements of the budget adoption process; and

 

WHEREAS, Section 805(i) of the Charter authorizes the Council to change those dates and the Council desires to change them to be consistent with the new fiscal year; NOW, THEREFORE,


BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Chapter 2, Article II of the Code of Ordinances is hereby amended by repealing Section 2-52, Budget Process, and enacting in its place a new section to read as follows:

 

Section 2-52 Fiscal Year and Budget Process.

(a) Short Fiscal Year. The fiscal year of the City beginning May 1, 2010, shall end December 31, 2010.

 

(b) Fiscal Year. Effective January 1, 2011, the fiscal year of the City shall begin with the first day of January and end with the thirty-first day of December next following.

 

(c) Budget. Effective May 1, 2010, the dates for elements of the budget adoption process shall be as follows:

 

(1) Budget priorities. The council, acting as committee of the whole, will meet on or before July 15 of each year and on or before August 15 of each year, to consider funding priorities for the next year's budget.

 

(2) Budget Requests.  Notwithstanding Section 803(a) of the Charter, on or before the 15th day of July of each year the head of each department under the City Manager and each department, board, commission and office not under the City Manager shall submit to the City Manager requests for appropriations necessary to fulfill the needs of the department, board, commission or office for the ensuing fiscal year. 

 

(3)    Recommendations of City Manager.  Notwithstanding the provisions of Section 804(a) of the Charter, an annual budget shall be prepared by the City Manager or by such other officer as the City Manager may instruct so to do, and shall be submitted to the Mayor not later than September 15. 

 

(4)    Transmittal to the Council by the Mayor.  Notwithstanding the provisions of Section 804(c) of the Charter, the Mayor shall transmit to the Council not later than the second regular meeting in October, the annual budget prepared by the City Manager, with any comments of the Mayor.

 

(5)    Report.  Notwithstanding Section 805(c) of the Charter, upon completion of its review of the budget, and in any case not later than the fourth regular meeting in October, the Council shall place on file in the office of the City Clerk a copy of the document to be considered and shall set a date for a public hearing thereon, but in no case later than the first regular meeting in November. 

 

(6)    Adoption of the budget.  Notwithstanding Section 805(d) of the Charter, at the third regular meeting in November the Council shall by ordinance adopt the annual budget in detail specified by the Charter, with or without alteration or amendment

 

(7)    Appropriation ordinances and establishment of tax levies.  Notwithstanding Section 805(g) of the Charter, the appropriation ordinance shall contain a statement of the estimated revenues for the ensuing fiscal year. Whenever practicable, ordinances fixing the tax levies shall be passed at the time the annual appropriation ordinance is passed, but no later than the third Monday in November. The Council may pass ordinances making additional appropriations after the passage of the annual appropriation ordinance, provided that such ordinances bear the certificate of the Director of Finance that a sufficient unappropriated balance remains in the fund from which the appropriation is to be made in accordance with the provisions of the Charter.
