Approving the preliminary plat of
Park Plaza Commercial on about an 11.9 acre tract of land generally located at
the northwest corner of N.W. 64th Street and Interstate 29. (SD0583A)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat of Park Plaza Commercial on about an 11.9 acre tract of
land generally located at the northwest corner of N.W. 64th Street and
Interstate 29, and more specifically described as follows:
A
tract of land in the Southeast Quarter of Section 19, Township 51 North, Range
33 West of the Fifth Principal Meridian, in Kansas City, Platte County,
Missouri, described as follows: Commencing at the Southeast Corner of said
Southeast Quarter; thence North 890048 West along the South line of said
Southeast Quarter, 1039.50 feet to the Southerly extension of the East line of
Lot 2, Picture Hills Second Plat, a subdivision of land in said Kansas City;
thence North 0052'06 East along said Southerly extension, 68.73 feet to a
point on the Northerly right of way line of Missouri State Highway No. 45, as
now established, said point also being the Point of Beginning of the tract to
be herein described; thence continuing North 0052'06 East, along said
Southerly extension and along the East line of said Lot 2, Picture Hills
Second Plat, 522.01 feet to the Southwest Corner of Lot E, Prairie Business
Center, a subdivision of land in said Kansas City; thence South 895615
East, along the South line of said Lot E:, the South line of Lot D, said
Prairie Business Center and the Easterly extension of said South Lot line,
894.50 feet to a point on the Westerly right of way line of Interstate Highway No.
29 as now established; thence South 275850 East, along said Westerly right
of way line, 265.93 feet; thence South 004747 West along said Westerly right
of way line, 263.78 feet to a point on said Northerly right of way line of
Missouri State Highway No. 45 as now established; thence South 7123'44 West
along said Northerly right of way line, 73.41 feet; thence North 8956'15
West, along said Northerly right of way line, 953.93 feet to the Point of
Beginning. Containing 11.89 acres more or less.
is hereby approved, subject to
the following conditions:
1. That the developer cause the area to be platted and processed
in accordance with Chapter 66, Code of Ordinances of the City of Kansas City,
Missouri, commonly known as the Subdivision Regulations.
2. That the developer dedicate additional right of way with the
first phase for a modified secondary arterial street as required by Development
Services so as to provide a minimum of 60 feet of right of way plus the
necessary turn lanes for relocated N.W. Prairie View Road and as provided in
the addendum to the Major Street Plan.
3. That the developer improve relocated N.W. Prairie View Road
with the first phase to modified secondary arterial street standards with the
necessary turn lanes, as required by Development Services, including curbs,
gutters, storm sewers, sidewalks, streetlights, existing roadway section
transitions to meet vertical and horizontal alignment standards, and relocation
of utilities.
4. That the developer submit a macro/micro storm drainage study
to Development Services for review and acceptance for the entire development
when the first final plat is submitted, and that the developer construct any
improvements as required by Development Services.
5. That the developer secure permits for the sidewalks within
the development at the time street improvement permits are secured, as required
by Development Services, prior to recording the plat.
6. That the developer subordinate to the City all private
interest in the area of any right-of-way dedication, as required by Development
Services, and that the developer be responsible for all costs associated with
subordination activities now and in the future.
7. That the developer submit a letter from a licensed civil engineer,
licensed architect, or licensed landscape architect, who is registered in the
State of Missouri, stating the condition of the sidewalks, curbs, and gutters.
The letter must identify state of repair as defined in Chapters 56 and 64, Code
of Ordinances, for the sidewalks, curbs, and gutters. It shall identify the
quantity and location of sidewalks, curbs, and gutters that need to be
constructed, repaired, or reconstructed. The developer shall secure permits to
repair or reconstruct the identified sidewalks, curbs, and gutters as necessary
along all development street frontages, as required by Development Services,
prior to recording the plat.
8. That the developer submit plans for grading, siltation, and
erosion control to Development Services for review, acceptance, and permitting
prior to beginning any construction activities, prior to recording the plat.
9. That the developer secure a site disturbance permit from
Development Services prior to beginning any construction, grading, clearing, or
grubbing activities, if the disturbed area equals one acre or more, prior to
recording the plat..
10. That the developer secure permits to extend sanitary sewers to
ensure individual service is provided to all proposed lots and determine
adequacy as required by Development Services, prior to recording the plat.
11. That the developer secure permits to provide a storm water
conveyance system to serve all proposed lots within the development and
determine adequacy as required by Development Services, prior to recording the
plat.
12. That the developer grant a BMP Easement to the City as
required by Development Services, prior to recording the plat.
13. That the developer enter into a covenant agreement for the
maintenance of any stormwater detention area tracts as required by Development
Services.
14. That the developer install hard surface roads and provide for
fire protection as required by the Fire Department prior to construction beyond
foundations.
15. That the developer extend/relocate water mains and grant
exclusive easements as required by the Water Services Department.
16. That the developer secure approval of the Street Naming
Committee for all street names prior to submittal of the first final plat, and
that the developer submit a copy of the approved street name plan as part of
each final plat submittal to the Department of City Development.
A copy of the preliminary plat is
on file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices have been given and hearings have
been held as required by the Subdivision Regulations.
