Approving
a development plan in District GP-7 (Agricultural and Low Density Residential Uses)
on approximately a 32.4 acre tract of land generally located on the south side
of N.W. 117th Terrace, approximately 1/2 mile east of N. Skyview Avenue.

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That a development plan in District GP-7 (Agricultural and Low Density
Residential Uses) on approximately a 32.4 acre tract of land generally located
on the south side of N.W. 117th Terrace, approximately 1/2 mile east of N.
Skyview Avenue, and more specifically described as follows:
A tract of land in the South Half of the West
Half of the Northwest Quarter of Section 20, Township 52 North, Range 33 West,
Kansas City, Platte County, Missouri, lying south of the service road right of
way on the south side of I-435, and being more particularly described as
follows: Beginning at the northwest corner of said Northwest Quarter; thence
South 0E04'47" West, along
the west line of said Northwest Quarter, 1583.48 feet to the south right of way
line of the south service road of I-435, said point also being the true point
of beginning; thence along the south right of way line of said service road the
following bearings and distances: North 74E44'18"
East, 88.62 feet; North 82E14'16"
East, 155.75 feet; North 89E44'15"
East, 415.80 feet; South 89E14'25"
East, 633.38 feet to a point on the east line of the West Half of said
Northwest Quarter; thence South 00E15'10"
West, along the east line of said West Half, 1093.45 feet to the south line of
said Northwest Quarter; thence North 89E53'46"
West, along the south line of said Northwest Quarter, 1285.59 feet to the
southwest corner of said Northwest Quarter; thence North 00E04'47" East, along the west line of
said Northwest Quarter, 1053.24 feet to the true point of beginning, except
part in roads.
is
hereby approved, subject to the following conditions:
1. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
2. That
the developer obtain permits from the Department of Public Works prior to
working in the Citys public right of way (driveways, approaches, grading,
etc.).
3. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
4. That
the developer comply with the Kansas City International Airport height
regulations as required by the Aviation Department.
5. That the developer grant an
Aviation and Noise Easement to the City as required by the Aviation Department
prior to the approval of a final plan.
6. That the developer submit a
final plan to the City Plan Commission for approval, including plans for
landscaping, screening, grading and building elevations.
A copy of said development
plan is on file in the office of the City Clerk under Document No. 010255,
which is attached hereto and made a part hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
