COMMITTEE SUBSTITUTE ORDINANCE NO. 980416

 

Approving an amendment to a previously approved Community Unit Project on an approximately 90 acre tract of land generally located at the northeast corner of 135th Street (150 Highway) and State Line Road. (7260-CUP-6)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved Community Unit Project on an approximately 90 acre tract of land generally located at the northeast corner of 135th Street (150 Highway) and State Line Road, more specifically described as follows:

 

All that part of the North Half of Fractional Section 19, Township 47, Range 33 in Kansas City, Jackson County, Missouri, being more particularly described as follows: Commencing at the southwest corner of the North Half of said Fractional Section 19; thence South 8611'03" East along the south line of said North Half, a distance of 719.85 feet; thence North 041'01" West, 78.68 feet to a point on the north right of way line of Missouri State Highway Route No. 150 (135th Street), as now established and the point of beginning of the tract of land to be herein described; thence the following courses and distances along the east line of a parcel of land currently zoned C-2-p by Ordinance No. 50600, passed August 2, 1979; thence continuing North 041'01" West, 682.50 feet; thence North 1857'01" West, 400 feet; thence North 4707'59" East, 275.38 feet; thence North 2427'01" West, 133.20 feet; thence North 005'01" West, 1160.76 feet to a point on the south right of way line of Blue Ridge Boulevard, as now established; thence South 8550'03" East along said south right of way line, a distance of 1605.94 feet to a point on the east line of the North Half of said Fractional Section 19; thence South 339'20" West along said east line, a distance of 2566.59 feet to a point on the north right of way line of said Missouri State Highway Route No. 150 (135th Street); thence North 8409'21" West along said north right of way line, a distance of 1452.58 feet to the point of beginning. Containing 90.039 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of General Ordinances of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineers Office for approval for the entire development when the first plat is submitted and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.


4. That the developer secure a Land Disturbance Permit from the Missouri Department of Natural Resources.

 

5. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the private open space with the final plat.

 

6. That the developer secure the approval of the Street Naming Committee for all street names.

 

7. That the developer provide for fire protection and install hard surface roads as required by the Fire Department prior to construction beyond foundations.

 

8. That the developer construct temporary cul-de-sacs as required by the Department of Public Works for each phase.

 

9. That the developer extend water mains as required by the Water Services Department.

 

10. That the developer extend sanitary sewers as required by the Department of Public Works.

 

11. That the developer dedicate an additional five (5') feet of right-of-way for Blue Ridge Boulevard as required by the Department of Public Works.

 

12. That the developer improve Blue Ridge Boulevard from State Line Road to the east approximately 1,500 feet as required by the Department of Public Works so as to provide for a four lane cross-section, by constructing four 12 foot lanes, a 16 foot wide median with landscaping, and curb, gutter, sidewalks and street lights to primary arterial street standards and tapering into the existing pavement east of St. Andrew Drive as provided on the attached Community Unit Project Plan.

 

13. That the developer dedicate additional right-of-way for 135th Street as required by the Department of Public Works so as to provide 40 feet of right-of-way as measured from centerline of 135th Street.

 

14. That the developer improve one half of 135th Street to secondary arterial street standards as required by the Department of Public Works, including sidewalks and streetlights.

 

15. That the developer secure a permit from the Missouri Highway and Transportation Department prior to working in any right of way.

 

16. That the developer construct eastbound and westbound left turn lanes on Blue Ridge Boulevard at Inverness Drive as required by the Department of Public Works.

17. That the developer construct an eastbound left turn lane on 135th Street at Inverness Drive at such time as Inverness Drive is extended to 135th Street as required by the Department of Public Works.

 

18. That the developer receive the approval of the Board of Zoning Adjustment for any signage or any variances.

 

19. That the developer construct no structure which exceeds the height zoning restrictions in accordance with the Richards-Gebaur Memorial Airport Height Zoning Restrictions.

 

20. That the developer contribute $92,175.00 to the Martin City Area Study Improvement Fund based on $450.00 per single family and duplex unit, $225.00 per unit for the multifamily units, and $95.00 per bed for elderly care facility.

 

21. That the developer construct all private roads to public street standards as required by the Department of Public Works, including curb, gutter, sidewalks as provided on the Community Unit Project Plan, and streetlights.

 

22. That the developer contribute $32,768.66 in lieu of parkland dedication for 70 single family units, 26 duplex units, and 261 multifamily units in satisfaction of Section 66-128 of the Subdivision Regulations.

 

23. That the developer submit a street tree planting plan with the final plat to the City Forester for approval. The street tree planting plan shall include size, species, spacing and type of street trees with a copy to be provided to the Department of City Development.

 

24. That the developer submit a final plan for each stage to the City Plan Commission for approval, including information on signage, landscaping, berming, screening, fencing and private open space.

 

25. That the developer construct the public road on the south side of Phase 8 as shown on the attached Community Unit Project Plan to collector street standards as required by the Department of Public Works at such time as either Phase 8 is platted, Phase 4B is platted or a total of 189 units are platted as shown on the attached Community Unit Project Plan; whichever first occurs.

 

26. That the developer construct an access drive from the westerly line of Phase 8 as shown on the attached Community Unit Project Plan to State Line Road as required by the Department of Public Works by constructing a 24 foot wide paved access drive with no curbs, gutters or sidewalks at such time as either Phase 8 is platted, Phase 4B is platted or a total of 189 units are platted as shown on the attached Community Unit Project Plan; whichever first occurs.

A copy of said Community Unit Project plan amendment is on file in the office of the City Clerk under Document No. 980416, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
