RESOLUTION NO. 090321

 

Honoring Lilly Ledbetter and welcoming her to Kansas City, Missouri.

 

WHEREAS, on January 29, 2009, President Obama signed his first major piece of legislation, the Lilly Ledbetter Fair Pay Restoration Act; and

 

WHEREAS, Lilly Ledbetter worked for nearly two decades at a Goodyear Tire plant in Gadsden, Alabama and brought an Equal Employment Opportunity Commission complaint against Goodyear after she discovered that for years she had been paid less than male co-workers with the same job; and

 

WHEREAS, Lilly Ledbetter lost her case in Supreme Court with a decision that the statute of limitations for presenting an equal-pay lawsuit begins at the date the pay was agreed upon, not at the date of the most recent paycheck; and

 

WHEREAS, the 110th United States Congress introduced a bill that would amend the statutory limitations periods and supersede the Ledbetter decision but it was never enacted; and

 

WHEREAS, the bill was eventually reintroduced in the first session of the 111th United States Congress where it obtained the necessary votes to pass and was then brought to the attention of the President and became the first act of Congress signed by the President since his assumption of office; and

 

WHEREAS, the message being sent by the signing of the Lilly Ledbetter Fair Pay Restoration Act is that there is no second class citizens in the workplace and it is not just unfair and illegal but bad for business to pay someone less because of their gender, age, race, ethnicity, religion or disability; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

That the Mayor and Council hereby honor Lilly Ledbetter and welcome her to Kansas City, Missouri; and

 

BE IT FURTHER RESOLVED that this Resolution be spread upon the Minutes of the Council in testimony thereof and that a copy hereof be presented to Lana Ultican on behalf of Lilly Ledbetter with the appreciation of the Mayor, Council and all citizens of Kansas City for making our country a better place to live and raise our families in.
