COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 090045

 

Approving the allocations in the FY 2010-14 Capital Improvements Program preliminary budget and the FY 2010 Neighborhood Conservation Projects as set forth in this ordinance; reducing appropriations in 2 current project accounts in the amount of $944,463.14, stating the Council's intention regarding advance funding of the FY 2010-14 Capital Improvement Program projects; and directing the Director of Public Works to enter into a $1,000,000.00 contribution agreement for the construction of the Vivion Road project.

 

WHEREAS, the Public Improvement Advisory Committee (PIAC) makes recommendations each year on the 5-Year Capital Improvements Program and the City Manager is directed to include the 5-Year Capital Improvements Program in the annual budget; and

 

WHEREAS, the City Manager has included in the FY 2009-10 budget submitted to the Mayor, the FY 2010-14 Capital Improvements Program preliminary budget; and

 

WHEREAS, time is of the essence in beginning capital improvement projects due to the length of the construction process and the Council desires that staff begin work on new projects as soon as possible; and

 

WHEREAS, the Council also desire to provide current funding for a curb and sidewalk program; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council hereby approves the allocations in the FY 2010-14 Capital Improvements Program preliminary budget, and the allocations in the FY 2010 Neighborhood Conservation Project list as set forth on Exhibits 1 and 2, respectively, attached to this ordinance.

 

Section 2. That the appropriations in the following accounts are hereby reduced by the following amounts:

 

09-3090-648042-64006106-G Mexican Customs Facility $759,286.84

09-3090-898913-89008142-B 8th Street Connector 185,176.30

TOTAL $944,463.14

Section 3. That the Council hereby states its intention to provide funding, prior to May 1, 2009, necessary to allow the City to begin work on the projects included in Exhibit 1and 2 as soon as possible, subject to availability of funds.

 


Section 4. That the Director of Public Works is directed to execute a contribution agreement, on or before July 1,2009, in the amount of $1,000,000.00 for the Vivion Road project with the City of Riverside and/or the Missouri Department of Transportation, as appropriate, to ensure the timely construction of the project, subject to the appropriation of funds in FY 2010-11. The contribution agreement shall contain a provision that the Citys contribution will be withdrawn and the agreement will be terminated if a notice to proceed is not issued by May 1, 2011.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
