Approving the preliminary plat of
Rice Estates in Districts R-7.5 and MPD, on about 4 acres generally located at
the southeast corner of E. 58th Street and Crystal Avenue, creating four (4)
lots. (SD 1544)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat of Rice Estates in Districts R-7.5 (Residential dash 7.5)
and MPD (Master Planned District), on about 4 acres generally located at the
southeast corner of E. 58th Street and Crystal Avenue, and more specifically
described as follows:
A
tract of land in the Southeast Quarter of Section 36, Township 49 North, Range
33 West of the 5th Principal Meridian in Kansas City, Jackson County, Missouri
being bounded and described as follows: Commencing at the Southeast corner of
said Southeast Quarter; thence North 87 degrees 37 minutes 23 seconds West,
along the South line of said Southeast Quarter, 47.83 feet to the point of
beginning of the tract of land to be herein described; thence continuing North
87 degrees 37 minutes 23 seconds West, along said South line, 557.79 feet to a
point on the apparent East right-of-way line of Crystal Avenue, as now
established; thence North 02 degrees 12 minutes 47 seconds East, along said
East right-of-way line, 554.22 feet to a point on the Southerly right-of-way
line of East 58th Street, as now established; thence North 76 degrees 24
minutes 47 seconds East, along said Southerly right-of-way line, 168.19 feet to
a point on the Westerly right-of-way line of Interstate Highway 435, as now
established; thence South 24 degrees 50 minutes 24 seconds East, along said
Westerly right-of-way line, 245.76 feet; thence South 34 degrees 22 minutes 47
seconds East, continuing along said Westerly right-of-way line, 476.71 feet to
the point of beginning. Containing 202,607 square feet or 4.65 acres, more or
less.
is hereby approved, subject to
the following conditions:
1.
The developer shall record the proposed deed restriction language in
lieu of public improvements that states “No building permits shall be issued
for Lots 3 & 4 until public utilities have been extended as required by the
Land Development Division and the Water Services Department, parkland
dedication or payment in lieu of has been completed as required by the Parks
and Recreation Department, and a street tree plan has been approved by the City
Forester and trees have been planted in accordance with that plan.” The deed
restrictions will be recorded prior to recording the final plat.
2.
The developer shall submit a final MPD Plan to the Director of City
Planning and Development for approval by the Development Review Committee prior
to issuance of a building permit for Lot 2. The final MPD Development Plan
shall meet the development standards of Chapter 88-400 including plan
information, property uses, setback distances, lighting (with a photometric
study), landscaping, including information on (i) species, planting size, and
spacing of all trees and shrubbery; (ii) buildings and dumpster elevation
drawings, (iii) fencing, if utilized, identifying material, color, height,
setback and type, with an elevation drawing of a section, streetscaping,
signage (including elevations), and architectural characteristics.
3.
The developer shall submit a street tree planting plan with each final
plan and secure the approval of the City Forester for street trees planted in
the right of way in front of residential lots, with a copy to be submitted to
the Development Management Division prior to approval and issuance of building
permit for Lots 3 and 4. The plan shall include size, type, species and
placement of trees. The developer shall agree to plant in accordance with the
plan approved by the City Forester.
4.
The developer shall submit a street naming plan to the Development
Management Division with any future final plan. The street naming plan shall
be submitted prior to Mylar approval. The street naming plan shall be approved
prior to issuance of addresses for this development.
5.
The developer shall cause the area to be platted and processed in
accordance with Chapter 88, Code of Ordinances of the City of Kansas City,
Missouri.
6.
The developer shall submit a storm drainage analysis from a
Missouri-licensed civil engineer to the Land Development Division, in
accordance with adopted standards, including a BMP level of service analysis
prior to approval and issuance of any building permits, and the developer shall
secure permits to construct any improvements as required by the Land
Development Division, prior to issuance of any certificate of occupancy.
7.
The developer shall dedicate an access easement for Crystal Avenue for
public access, a minimum of 25 feet in width, along those areas being platted,
prior to recording the final plat.
8.
The developer shall secure permits to extend public sanitary and storm
water conveyance systems to serve all proposed lots within the development and
determine adequacy of receiving systems as required by the Land Development
Division, prior to approval and issuance of any building permit for Lots 3
& 4.
9.
The developer shall extend water mains and provide fire hydrants as
required by the Water Services Department prior to approval and issuance of any
building permit for Lots 3 & 4.
10.
The developer shall provide easements as required by the Water Services
Department.
11.
The developer shall either dedicate 3.57 acres or contribute money in
lieu of parkland dedication in satisfaction of Section 88-408 of the Zoning and
Development Code prior to approval and issuance of any building permit for Lots
3 & 4.
A copy of the preliminary plat is
on file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices and hearings required by the
Zoning and Development Code have been given and had.
