ORDINANCE NO. 090188

 

Ordering the Improvements within the 22nd Street Neighborhood Improvement District be made and financing therefore obtained by special assessment.

 

  WHEREAS, pursuant to the authority of Sections 67.453 to 67.475 inclusive, RSMo, titled the Neighborhood Improvement District Act (the Act), the City Council of Kansas City, Missouri has determined the operation and maintenance of certain existing decorative pedestrian lighting and decorative brick sidewalk (the Improvements) to be advisable and has ordered the creation of a neighborhood improvement district for that purpose, all as set forth in Ordinance No. 090100; and

 

WHEREAS, plans and specifications have been prepared, including the estimated annual costs of said operation and maintenance, and have been submitted to the Council; and

 

WHEREAS, an assessment roll was prepared and distributed, and pursuant to notice duly given, a hearing was held on the proposed Improvements and assessments; NOW THEREFORE,

 

  BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Improvements are ordered to be made and financing for the cost thereof obtained by special assessment.

 

Section 2. That a special assessment shall be levied and collected annually, for a period of 15 years, against each property within the 22nd Street Neighborhood Improvement District, said assessments to be made against each property according to the method of assessment provided for in Ordinance No. 090100. The sum assessed against any property within the district during any given year shall not exceed the amount set forth in the assessment role by more than 25%.

 

 Section 3. That it is hereby found and determined that the benefits to each property within the district exceed the cost that may be assessed to such property.
