ORDINANCE NO. 110424
Authorizing the Director of
Public Works to enter into an amendment to a cooperative agreement with Hunt
Midwest Real Estate Services, Inc. for the purpose of providing additional
funding for the construction of the next phase of the Line Creek Trail; and authorizing
the Director of Public Works to expend an additional $695,000.00 on the
project.
WHEREAS, under
Committee Substitute for Ordinance No. 090697, passed August 13, 2009, the City
Council authorized the Director of Public Works to enter into a public
infrastructure agreement with Hunt Midwest Real Estate Development, Inc. for
the construction of the Line Creek Trail; and
WHEREAS,
Ordinance No. 110123, passed February 24, 2011, authorized additional funding
for the Line Creek Trail; and
WHEREAS, the
City wishes to increase the amount of the public infrastructure agreement to
expend additional funding for the project and complete the next phase of the
trail this summer; and
WHEREAS, those
factors justifying the construction of the first phase of the trail through a
cooperative partnership with Hunt Midwest Real Estate Development, Inc.,
continue to exist and support the continuation of that cooperative effort for
the next phase of the trail; NOW, THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the Director of Public Works is hereby authorized to execute a $695,000.00
amendment to Agreement No. CS100047, Cooperative Agreement for Public/Private
Project – Line Creek Trail, with Hunt Midwest Real Estate Development, Inc., for
the purpose of constructing the next phase of the Line Creek Trail. A copy of
the amendment is on file in the office of the Director of Public Works.
Section 2. That
the Director of Public Works is hereby authorized to expend an additional
$695,000.00 from funds previously appropriated to Account No. AL-3397-898209-B-89020048
as and for consideration for the aforementioned amendment to Agreement No.
CS100047

I hereby certify
that there is a balance, otherwise unencumbered, to the credit of the
appropriation to which the foregoing expenditure is to be charged, and a cash
balance, otherwise unencumbered, in the treasury, to the credit of the fund
from which payment is to be made, each sufficient to meet the obligation hereby
incurred.
