COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 050217

 

Rezoning an area of approximately 1.25 acres generally located at the northwest corner of the Kansas City/Gladstone city limit line and N. Agnes Avenue and north of N.E. 76th Street from District RA to District R-1a. (13292-P)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0614, rezoning an area of approximately 1.25 acres generally located at the northwest corner of the Kansas City/Gladstone city limit line and N. Agnes Avenue and north of N.E. 76th Street 1500 feet north of Phelps Road on the west side of Lee=s Summit Road from District RA (Agricultural) to District R-1a (One-Family Dwellings, Medium Density), said section to read as follows:

 

Section 80-11A0614. That an area legally described as:

 

All that part of the Northwest Quarter of Section 18, Township 51, Range 32, in Kansas City, Clay County, Missouri, described as follows: Beginning at a point on the West line of the East Half of the Northwest Quarter of Section 18, Township 51, Range 32, and 842.1 feet North of the Southwest corner thereof; thence East and parallel to the North line of the South Half of the South Half of the North Half of Section 18, Township 51, Range 32, a distance of 239 feet to a point in the center of Agnes Avenue; thence North 10 degrees 18 minutes West, a distance of 310 feet; thence West and parallel to the North line of the South Half of the South Half of the North Half of Section 18, Township 51 Range 32, a distance of approximately 183 feet to a point in the West line of the East Half of the Northwest Quarter of Section 18, Township 51, Range 32; thence South in the West line of the East Half of the Northwest Quarter of Section 18, Township 51, Range 32, a distance of approximately 305 feet to the Point of Beginning, EXCEPT any part in streets or roads.

 

is hereby rezoned from District RA (Agricultural) to District R-1a (One-Family Dwellings, Medium Density), all as shown outlined on a map marked Section 80-11A0614, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That the developer will construct sidewalks on the west side of N. Agnes Avenue (along the propertys frontage within Kansas City) before a building permit is issued for a new single family residence.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
