COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 191024

 

Amending Resolution No. 47523, which created a local port authority, for the purpose of designating specific port districts.

 

WHEREAS, pursuant to the provisions of Chapter 68 of the Revised Statues of Missouri, as amended, on February 11, 1977, the City Council adopted Resolution No. 47523 creating the Kansas City, Missouri Port Authority; and

 

WHEREAS, Section 68.015 of the Revised Statutes of Missouri required the City to designate what area comprised one or more port districts; and

 

WHEREAS, Resolution No. 47523 designated the Kansas City Port District as the total area within the corporate limits of Kansas City, Missouri; and

 

WHEREAS, the Council believes focusing port district boundaries to areas where the business of a port would more reasonably occur is appropriate; and

 

WHEREAS, Section 68.015 of the Revised Statutes of Missouri allows modifications to port district boundaries and requires any such modifications be approved by the Missouri Highways and Transportation Commission; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Resolution No. 47523 is amended by repealing Section 2 and enacting a new Section 2 to read as follows:

 

Section 2. That the following port districts are designated:

 

a.       The River District, which shall be a port district comprised of any parcel, tract, or lot touching the boundaries of the Missouri River and/or the Blue River as they now exist, and any area within one mile of such parcel, tract, or lot; and

 

b.      The Rail District, which shall be a port district comprised of any parcel, tract, or lot touching the boundaries of property containing operating rail tract, and any area within one mile of such parcel, tract, or lot; and

 

c.       The International Airport District, which shall be a port district comprised of any parcel, tract, or lot surrounding the Kansas City International Airport bounded by to the east by Interstate 435, to the north and east by Interstate 29, and to the south by N.W. 104th Street and any area within two miles of such parcel, tract, or lot; and

 

d.      The Downtown Airport District, which shall be a port district comprised of any parcel, tract, or lot surrounding the Charles B. Wheeler Downtown Airport bounded to the north, west and south by the Missouri River and to the east by Interstate 169, and any area within one mile of such parcel, tract, or lot; and

 

e.       The Richards-Gebaur District, which shall be a port district comprised of any parcel, tract, or lot surrounding the Richards-Gebaur Memorial Airport south of Highway 150 to the southerly City limits bounded to the west by Prospect Avenue or the City limits where the City limits lie to the east of Prospect Avenue and bounded to the east by Highway 71 or to the City limits where the City limits lie to the west of Highway 71, and any area within two miles of such parcel, tract, or lot.

 

Section 3. That notwithstanding the foregoing provisions of this Resolution, the City Council shall retain its discretion to authorize or expand any port district by ordinance or resolution. In determining whether to authorize or expand any port districts beyond areas described herein, the City Council shall give particular consideration to projects located in a severely distressed census tract that has continuously maintained such status for not less than ten (10) years immediately prior to the effective date of the request.

 

Section 4. That this Resolution shall apply prospectively only and shall not be construed in a manner as to impair any agreement prior to the effective date thereof. 

 

Section 5. That the City Clerk is directed to submit this Resolution to the Missouri Highways and Transportation Commission for the purpose of obtaining its approval of the boundary change.

 

Section 6. That the boundaries established by this Resolution shall be effective on the later of January 1, 2020 or receipt of approval from the Missouri Highways and Transportation Commission.
