COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 990847

 

Approving a development plan in District GP-7 (Agricultural and Low Density Residential Uses) on approximately a 30 acre tract of land generally located between N.W. Cookingham Drive on the north and I-435 on the south, approximately 1,600 feet east of N. Robinhood Lane. (12298-GP)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a development plan in District GP-7 (Agricultural and Low Density Residential Uses) on approximately a 30 acre tract of land generally located between N.W. Cookingham Drive on the north and I-435 on the south, approximately 1,600 feet east of N. Robinhood Lane, and more specifically described as follows:

 

Tract of land in the Northwest Quarter (1/4) of Section 21, Township 52, Range 33, in Kansas City, Platte County, Missouri, lying north of I-435 right of way, more particularly described as follows: Beginning at a point 64 rods east of the northwest corner of the Northwest Quarter (1/4) of said Section 21; running thence east 64 rods; thence south 160 rods; thence west 64 rods; thence north 160 rods to the place of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer extend water mains as required by the Water Services Department.

 

5. That the developer provide for fire protection as required by the Fire Department.

 

6. That the developer dedicate additional right of way for N.W. Cookingham Drive as required by the Department of Public Works so as to provide a total of 50 feet of right of way as measured from the centerline of N.W. Cookingham Drive.

 

7. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.


8. That the developer extend sanitary sewers as required by the City Engineers Office.

 

9. That the developer grant an Aviation Noise Easement to the City as required by the Aviation Department.

 

10. That the developer comply with the KCI Airport Height Zoning restrictions and that no structure shall be constructed which exceeds these restrictions.

 

11. That the developer relocate the proposed driveway entrance on N.W. Cookingham Drive if adequate site distance is not available for the proposed location as required by the Department of Public Works.

 

12. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, grading and signage, prior to the issuance of a building permit.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 990847, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
