RESOLUTION NO. 020302

 

Amending the Citys 2002 legislative priorities by including support for funding the Missouri Office of Public Counsel.

 

WHEREAS, the Council has established 2002 legislative priorities for the Missouri General Assembly by adoption of Resolution No. 011693; and

 

WHEREAS, as a function of the dramatically reduced revenues anticipated by the State of Missouri, continued State general fund support for the Office of Public Counsel is not included in the proposed Missouri State Budget; and

 

WHEREAS, House Bill 1914 would provide for funding of the Office of Public Counsel through assessments not to exceed .03% of the general operating revenues of utility companies, which funding would be approximately $1.3 million per year; and

 

WHEREAS, this method of funding public advocates such as the Office of Public Counsel is common in the United States, with over three-quarters of all consumer advocates ultimately funded through rate payers; and

 

WHEREAS, it estimated that utility bills may be increased by only 18 per year for a customer, but the Office of Public Counsel has served as a restraining factor on escalating utility bills by fighting vigorously for the rights of residential utility consumers and small businesses before the Missouri Public Service Commission, saving last year an estimated $24 for a customer; and

 

WHEREAS, the functions of the Office of Public Counsel cannot be effectively assumed by any other agency or entity because of legal constraints prohibiting municipalities from intervening in utility matters to represent consumers; and

 

WHEREAS, a piecemeal attempt at de facto consumer protection through individually affected cities would be costly and generally ineffective because of splintered representation of consumers before the Public Service Commission; and

 

WHEREAS, retention of the Office of Public Counsel as a distinct unit of government is essential to effective consumer protection and as a voice for all citizens of Missouri; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

That the Councils 2002 legislative priorities for the 2002 session of the Missouri General Assembly be amended to include the passage of House Bill 1914 for funding of the Office of Public Counsel.
