ORDINANCE NO. 050356

 

Approving certain revisions to the Oak Park Urban Renewal Plan for selected areas of approximately 1.26 acres of land generally located on both sides of Wayne Avenue between 39th Street and 40th Street. (120-S-10)

 

WHEREAS, by passage of Committee Substitute for Ordinance No. 36287, passed January 17, 1969, the City Council approved a General Urban Renewal Plan and the feasibility of relocation for the Oak Park Urban Renewal Area, a copy of which was filed with the City Clerk; and

 

WHEREAS, by enactment of Ordinance No. 39874, on July 16, 1971, the City Council approved a definitive urban renewal plan for said area; and

 

WHEREAS, by enactment of Ordinance No. 52481, passed February 27, 1981, and Ordinance No. 54269, passed August 26, 1982, the City Council approved certain revisions to the Oak Park Urban Renewal Plan and further revised the Plan by passage of Ordinance No. 951267, passed October 12, 1995; Ordinance No. 960653, passed June 27, 1996; Ordinance No. 970572, passed June 5, 1997; Ordinance No. 990637, passed June 10, 1999; Ordinance No. 021199, passed October 24, 2002; and Ordinance No. 031331, passed January 8, 2004; and

 

WHEREAS, because of planning and other considerations, the Land Clearance for Redevelopment Authority of Kansas City, Missouri, has considered it necessary and desirable to amend the Urban Renewal Plan for the Oak Park Urban Renewal Area for selected areas of approximately 1.26 acres of land generally located on both sides of Wayne Avenue between 39th Street and 40th Street; and

 

WHEREAS, a copy of the revision has been filed with the City Clerk; and

 

WHEREAS, the Land Clearance for Redevelopment Authority on March 1, 2005, approved a resolution setting forth the amendments to the Urban Renewal Plan, and a copy of said resolution is incorporated as part of said amended plan; and

 

WHEREAS, the City Plan Commission on January 4, 2005, reviewed the revisions to the Urban Renewal Plan and has found said plan to be in conformity with the Master Plan for the development of the City as a whole and recommended approval of the amendment by resolution to change the recommended use from multi-family to single-family residential for selected areas of approximately 1.26 acres of land generally located on both sides of Wayne Avenue between 39th Street and 40th Street. A copy of the resolution is attached hereto and incorporated herein by reference as Exhibit "A," subject to certain findings and conditions; NOW, THEREFORE,

 


BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That certain revisions to the Urban Renewal Plan for the Oak Park Urban Renewal Area, a copy of which is on file in the office of the City Clerk with this ordinance and which is incorporated herein by reference are hereby approved.

 

Section 2. That the amendment changes the recommended land use from multi-family to single-family residential for approximately 1.26 acres generally located on the both sides of Wayne Avenue between 39th Street and 40th Street, and more specifically described as follows:

 

The east 47 feet of the south 169.97 feet of the north 199.97 feet of the west 127.7 feet of the west 1/2 of Lot 3, Christian Hellmans Estate,

 

The north 93 feet of Lot 27, and all Lots 28 and 29, Dewey Park, except that portion in right of way,

 

The east 64.33 feet of Lots 24, 25 and 26, except that portion in right of way, and the south 30 feet of the west 75 feet of Lot 24, Dewey Park, and

 

All Lots 14, 15 and 16, Dewey Park, subdivisions in Kansas City, Jackson County, Missouri

 

Section 3. That it is hereby found and determined that all of the findings, determinations, and conclusions made and set forth in Resolution No. 36285, dated January 1, 1969, with respect to the eligibility of the area for urban renewal treatment; as well as Ordinance No. 36827, passed January 17, 1969, approving the general urban renewal plan for the Oak Park Urban Renewal Area; Ordinance No. 39874, passed July 16, 1971, approving a definitive plan for the Oak Park Urban Renewal Area; and Ordinance Nos. 52481, 54269, 951267, 960653, 970572, 990637, 021199, and 031331, passed February 27, 1981, August 26, 1982, October 12, 1995, June 27, 1996, June 5, 1997, June 10, 1999, October 24, 2002, and January 8, 2004, respectively, approving certain revisions to said Plan; apply with equal force and effect to the area as of the date of this revision.

 

Section 4. That said Urban Renewal Plan, as revised, is hereby found to be feasible and in conformity with the Master Plan for the development of the community as a whole.
