RESOLUTION NO. 060823

 

Approving an amendment to the Oak Park North Area Plan by amending the Proposed Land Use Plan and Map for an area of approximately 2.2 acres generally located on the south side of 34th Street between Prospect Avenue and Montgall Avenue to recommend high density residential uses instead of public/semi-public, low density residential and retail commercial. (385-S-14)

 

WHEREAS, the Oak Park North Area Plan was approved by the City Council by Resolution No. 47190, adopted December 16, 1976, as a guide for future development and redevelopment of the area generally bounded by Troost Avenue, Stadium Drive and Leeds Trafficway, 31st Street and 39th Street; and

 

WHEREAS, the Oak Park North Area Plan was amended on April 13, 1989, by Resolution No. 63760; was amended on February 13, 1997, by Resolution No. 970096; was amended on June 17, 1999, by Resolution No. 990674; was amended on September 27, 2001, by Resolution No. 011206; was amended on June 6, 2002, by Resolution No. 020562; was amended on August 15, 2002, by Resolution No. 020911, was amended on December 5, 2002, by Resolution No. 021355; was amended by Resolution No. 031335 on January 8, 2004, was amended by Resolution No. 040330 on April 15, 2004; was amended by Resolution No. 041232 on December 9, 2004; and was further amended by Resolution No. 050509 on May 19, 2005; and

 

WHEREAS, after further review by the City Development Department it has been deemed appropriate to amend the Oak Park North Area Plan as it affects that area generally located on the south side of 34th Street between Prospect Avenue and Montgall Avenue to recommend high density residential uses instead of public/semi-public, low density residential and retail commercial; and

 

WHEREAS, public notice of a hearing before the City Plan Commission was published on April 17, 2006; and

 

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on June 20, 2006; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on June 20, 2006, recommend approval of the proposed amendment to the Oak Park North Area Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the amendment to the Oak Park North Area Plan is hereby approved as to the Proposed Land Use Plan and Map for that area generally located on the south side of 34th Street between Prospect Avenue and Montgall Avenue to recommend high density residential uses instead of public/semi-public, low density residential and retail commercial. A copy of the amendment to the Land Use Plan and Map of the Oak Park North Area Plan is attached hereto as Exhibit A and incorporated herein by reference.

 

Section B. That the amendment to the Oak Park North Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the law have been given and had.
