ORDINANCE NO. 050182

 

Approve a Community Unit Project on an approximately 53.64 acre tract of land generally located at the northwest corner of N.E. Pleasant Valley Road and N. Brighton Avenue. (12624-CUP-4)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 53.64 acre tract of land generally located at the northwest corner of N.E. Pleasant Valley Road and N. Brighton Avenue, and more specifically described as follows:

 

Beginning at the Northwest corner of the East half of the Southwest quarter of Section 20, Township 51, Range 32, thence North 0 Degrees, 27 Minutes, 05 Seconds East, 568.38 feet, thence South 89 Degrees, 26 Minutes, 32 Seconds East, 1,303.93 feet, thence South 0 Degrees, 39 Minutes, 57 Seconds West, 568.38 feet, thence South 0 Degrees, 39 Minutes, 55 Seconds West, 1006.50 feet, thence North 82 Degrees, 37 Minutes, 39 Seconds West, 1,593.03 feet, thence South 62 Degrees, 51 Minutes, 43 Seconds West, 182.18 feet, thence North 0 Degrees, 45 Minutes, 31 Seconds East, 902.15 feet, thence South 89 Degrees, 26 Minutes, 32 Seconds East, 440.00 feet, to the true point of beginning of this description. The above described tract of land contains 53.64 acres of land, more or less. Said tract is located in Clay County, Missouri, and is subject to all easements, right-of-ways and restrictions of record, if any.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit new or update the previously approved macro storm drainage study for the overall development to address the development amendments along with a detailed micro study for approval prior to approval of the next plat and make necessary improvements as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer dedicate additional right of way for N.E. Pleasant Valley Road as required by the Department of Public Works so as to provide a total of 56 feet of right of way as measured from the centerline of N.E. Pleasant Valley Road.

 

7. That the developer dedicate right of way for N. Brighton Avenue as required by the Department of Public Works so as to provide a total of 56 feet of right of way as measured from the centerline for N. Brighton Road.

 

8. That the developer construct temporary cul-de-sacs as required by the Department of Public Works.

 

9. That the developer submit a street tree planting plan to the Department of Parks and Recreation as part of the final plat application with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

10. That the developer extend water mains as required by the Water Services Department.

 

11. That the developer extend sanitary sewers as required by the Department of Public Works.

 

12. That the developer provide for fire protection as required by the Fire Department.

 

13. That the developer submit covenants, conditions and restrictions to the Law Department for approval for maintenance of any private open spaces and any detention areas with the final plat.

 

14. That the developer design and construct all interior streets to City standards as required by the Department of Public Works, including curb, gutter, storm sewers, streetlights, and sidewalks.

 

15. That the developer shall subordinate to the City all private interest in the area of any right-of-way dedication as required by the Department of Public Works, and that the developer shall be responsible for all costs associated with subordination activities.

 

16. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, grading, signage, screening, berming and fencing.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk with the ordinance, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
