ORDINANCE NO. 071144

 

Approving an amendment to a previously approved preliminary development plan in District GP-2 on approximately a 64.2 acre tract of land generally located on the east side of N. Ambassador Drive, just south of the proposed N.W. 104th Street. (6517-GP-25)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District GP-2 (General Transient Retail Business) on approximately a 64.2 acre tract of land generally located on the east side of N. Ambassador Drive, just south of the proposed N.W. 104th Street, and more specifically described as follows:

 

All of Lots 2, 3, 5, 8, 9, and 10, Executive Hills North 2nd plat, a subdivision in Kansas City, Platte County, Missouri

 

Together with: All of Lot 7, Executive Hills North, 2nd plat, now known as Tracts A and B.

 

Together with: All of Lot 4, Executive Hills North, a subdivision in Kansas City, Platte County, Missouri

 

Together with: All of Lot 11, Executive Hills North, a subdivision in Kansas City, Platte County, Missouri

 

Together with: All of Lot 11, Executive Hills North, a subdivision in Kansas City, Platte County, Missouri

 

Together with: All of Executive Hills North, a subdivision in Kansas City, Platte County, Missouri.

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer submit a storm drainage study to Development Services for approval for the entire development, and that the developer make any improvements as required by Development Services.

 

2.                  That the developer submit plans for grading and siltation and erosion control to Development Services for approval prior to the commencement of any construction activities.

 

3.                  That the developer obtain a Land Disturbance Permit from Development Services prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

4.                  That the developer extend water mains as required by the Water Services Department.

 

5.                  That the developer submit a final GP development plan to the City Plan Commission for approval including landscaping, signage, photometric study showing zero footcandles at the property lines and building elevations.

 

6.                  That the developer comply with the KCI Airport Height zoning restrictions and that the developer include a fair disclosure statement with any real estate transaction.

 

7.                  That the developer secure permits to repair sidewalks, curbs, and gutters as necessary along all development street frontages as required by Development Services in accordance with Chapters 56 and 64, Code of Ordinances, prior to issuance of a certificate of occupancy.

 

8.                  That the developer provide a general warranty deed to Development Services for an additional right of way dedication of a total of 46 feet from centerline along N. Congress Avenue prior to certificate of occupancy.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
