RESOLUTION NO. 010516

 

Approving an amendment to the Gashland Area Plan by amending the Proposed Land Use Plan and Map for an area of approximately 1.58 acres generally located at the southwest corner of N. Oak Trafficway and N.E. 79th Terrace, by changing the recommended land uses from office commercial uses to retail commercial uses. (215-S-6)

 

WHEREAS, on February 11, 1977, the City Council, through the adoption of Resolution No. 47383, adopted the Gashland Area Plan being the Plan for development and redevelopment of that area bounded by 96th Street on the north, the city limits of Gladstone on the south except at the extreme eastern limits which extend south to Pleasant Valley Road, N. Brighton Avenue on the east and the Clay-Platte County line on the west; and

 

WHEREAS, the Gashland Area Plan was amended through the adoption of Resolution No. 971066 on October 9, 1997; was amended through the adoption of Resolution No. 980922 on September 24, 1998; and was amended again through the adoption of Resolution No. 991459 on March 23, 2000; and

 

WHEREAS, after further review, it has been deemed appropriate to amend the Gashland Area Plan as it affects that area generally located at the southwest corner of N. Oak Trafficway and N.E. 79th Terrace, to modify the Proposed Land Use Plan and Map for such area from office commercial uses to retail commercial uses; and

 

WHEREAS, public notice of a hearing before the City Plan Commission was published on January 22, 2001; and

 

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on February 20, 2001; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on February 20, 2001, recommend approval of the proposed amendment to the Gashland Area Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the Gashland Area Plan is hereby amended as to the Proposed Land Use Plan and Map for that area of approximately 1.58 acres generally located at the southwest corner of N. Oak Trafficway and N.E. 79th Terrace, by changing the recommended land uses from office commercial uses to retail commercial uses. A copy of the amendment to the Gashland Area Plan is attached hereto as Exhibit A and incorporated herein by reference.

 

Section B. That the Gashland Area Plan and this amendment is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.


Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the law have been given and had.
