ORDINANCE NO. 150089

 

Rezoning an area of about 2.4 acres generally located on the south side of E. 38th Street between Bell Street and Genessee Street from District R-2.5 to District R-5. (14435-P)

 

WHEREAS, on February 18, 2014, the City Plan Commission recommended approval of a neighborhood downzoning in the Volker neighborhood: and

 

WHEREAS, the area to be downzoned was an area of about 91 acres generally bounded by W. 32nd Street on the north, W. 39th Street on the south, State Line Road on the west, Wyoming Street, Roanoke Road and Karnes Boulevard on the east; and

 

WHEREAS, Ordinance No. 140805, which purported to downzone the area that had been requested by the Volker Neighborhood Association, contained an incorrect legal description, which inadvertently omitted several parcels that were to be downzoned, and which had been included in the area recommended to be downzoned by the City Plan Commission, and

 

WHEREAS, the City Council now would like to correct the mistake in the previous ordinance by rezoning the omitted properties; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A0952, rezoning an area of approximately 2.4 acres generally located on the south side of E. 38th Street between Bell Street and Genessee Street from District R-2.5 to District R-5, from R-2.5 (Residential 2.5) to District R-5 (Residential 5), said section to read as follows:

 

Section 88-20A0952. That an area legally described as:

 

Lots 1 thru 7 and Lots 13 thru 20 Block 7 of Mellier Place

 

is hereby rezoned from Districts District R-2.5 to District R-5, all as shown outlined on a map marked Section 88-20A0995, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved. A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 


 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
