ORDINANCE NO. 980690

 

Authorizing a $7,704,000.00 payment to Kansas City Power and Light Company for rock excavation as provided in the Streetlight Agreement and recognizing an emergency.

 

WHEREAS, the Streetlight Agreement between the City and the Kansas City Power and Light Company provides in Section 6.3 that: The City shall pay a separate unit charge to the Company for rock excavation performed as part of the construction of the Streetlighting System. Such a unit charge shall be determined on the basis of a competitive bid solicited by the Company. The City shall pay the actual bid cost with no additional charges. The City shall have the right to review and approve the terms and conditions of the bid specification as well as the bid price selected by the Company; and

 

WHEREAS, the Kansas City Power and Light Company has sought bids for rock excavation based upon specifications acceptable to the City; and

 

WHEREAS, the Kansas City Power and Light Company has selected a bid price acceptable to the City; and

 

WHEREAS, Kansas City Power and Light Company has selected the firms of Carney Excavation Company, Inc., and L.E. Meyers Co., to provide this service; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That to meet an obligation incurred by the approval of the Streetlight Agreement in Ordinance No. 961654 to pay an extra amount for rock excavation necessary to construct an updated Streetlight System the Director of Public Works is authorized to expend the sum of $7,704,000.00 from funds previously appropriated to the following account to satisfy the cost of this obligation:

 

98-335-089-7787-T St Light Sys Expansion $7,704,000.00

 

Section 2. That this ordinance provides for the expenditure of funds to meet the current expenses of the City government and is recognized to be an emergency measure within the provisions of Article II, Section 15 of the Charter and shall take effect immediately upon passage.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
