COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 010431

 

Calling for submission to the voters of Kansas City, at a special election to be held on August 7, 2001, a question authorizing the Council of Kansas City to establish fees for the issuance of permits allowing interruption of public use of the public right of way that shall include a traffic control permit application fee not to exceed $100.00; a driving lane use fee based on a unit use fee not to exceed $1.00 per mile; a metered parking lane use fee not to exceed $6.00 per meter per day; a non metered parking lane use fee not to exceed $6.00 per calendar day for each 20 linear feet thereof; a use fee for sidewalks and other portions of the public right of way outside the portion designated for vehicular traffic and parking not to exceed $6.00 per calendar day for each 20 linear feet thereof; directing the City Clerk to notify the responsible election authorities of the election; recognizing this ordinance to be an emergency measure; declaring the effective date of the authorization; and stating the Councils intention to appropriate approved fees for street and traffic control purposes.

 

WHEREAS, a special election may be held throughout the City on August 7, 2001; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That an election is hereby called for submitting to the voters of Kansas City the question of authorizing the Council to establish fees for the issuance of permits allowing interruption of public use of the public right of way that shall include a traffic control permit application fee not to exceed $100.00; a driving lane use fee based on a unit use fee not to exceed $1.00 per mile; a metered parking lane use fee not to exceed $6.00 per meter per day; a non metered parking lane use fee not to exceed $6.00 per calendar day for each 20 linear feet thereof; a use fee for sidewalks and other portions of the public right of way outside the portion designated for vehicular traffic and parking not to exceed $6.00 per calendar day for each 20 linear feet thereof. The question shall be submitted to the voters at a special election to be held on August 7, 2001. If the question is approved, then the Council may establish the fees up to the following amounts:

 

Traffic control permit application fee not to exceed $100.00

 

Driving lane use fee based on a unit use fee

not to exceed $1.00 per mile

 

Metered parking lane use fee not to exceed $6.00

per meter per day

 

Non metered parking lane use fee not to exceed $6.00 per calendar

day for each 20 linear feet thereof

 

Use fee for sidewalks and other not to exceed $6.00 per calendar

portions of the public right-of-way day for each 20 linear feet thereof

outside the portion designated for

vehicular traffic and parking

 


Section 2. The notice of this election will read as follows:

Notice is hereby given that Kansas City has called an election to be held in the City on Tuesday, August 7, 2001, between the hours of 6:00 a.m. and 7:00 p.m. C. D. T., at which election all qualified voters residing within Kansas City, Missouri, will be given the opportunity to vote.

 

The official ballot will be in substantially the following form:

per meter per day

Section 3. That upon the effective date of this ordinance the City Clerk shall immediately deliver certified copies of this ordinance and notice of election to the Board of Election Commissioners of Kansas City, Missouri, to the Board of Election Commissioners of Clay County, Missouri, to the Board of Election Commissioners of Platte County, Missouri, and to the Clerk of the County Commission of Cass County, Missouri.

 

Section 4. This ordinance, providing for the submission of a question to the people of Kansas City, Missouri, is recognized to be an emergency measure within the meaning of Section 15, Article II, of the Charter of the City, and as such becomes effective immediately following approval by the Mayor.

 

Section 5. That the Council hereby states that if a majority of the qualified voters voting at the August 7, 2001, election vote in favor of the question, it intends to appropriate revenues received from the fees for maintenance, repair and improvements to streets and traffic control.

 

Section 6. If a majority of the qualified voters voting at the election shall vote in favor of the approval of the question, then the authority of the Council to adopt ordinances imposing the fees shall become effective immediately upon certification of the election results by the election authorities.
