Stating the Citys intent to issue bonds or use a lease purchase agreement to fund the regional jail project; estimating revenue in the Equipment Capital Lease Acquisition Fund in the amount of $600,000.00; appropriating that amount from the Unappropriated Fund Balance to the MCI Jackson County account; designating requisitioning authority; declaring the Citys intent to reimburse itself for certain expenditures; stating the Citys intent to replace certain public safety sales tax funds with other City resources; authorizing a $1,950,000.00 emergency contract with The Konrath Group, LTD, for Project No. 57000150 Jackson County Detention Center; authorizing the City Manager to amend and increase this contract by up to $150,000.00; authorizing the City Manager to expend the sum of $2,100,000.00; and recognizing an emergency.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

WHEREAS, Ordinance No. 090306, passed April 23, 2009, authorized the Director of Neighborhood and Community Services to enter into an Intergovernmental Cooperative Agreement with Jackson County to complete facility improvements for housing detainees and sentenced inmates, and

 

WHEREAS, the City will be closing the existing Municipal Correctional Institution (MCI) on August 1, 2009, and will need the new County facilities and improvements designed and constructed on or before August 1, 2009, and

 

WHEREAS, the housing of inmates is an essential operation of the City and the failure to provide this function will create an imminent threat to public health, welfare, and safety of the inmates and citizens if the new facilities are not completed within the required timeframe; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the City Council states its intent to issue tax-exempt bonds or use a Master Equipment Lease/Purchase Agreement to pursue funding for the balance of the regional jail project up to $600,000.00 with debt service to be paid from non-General Fund resources in FY 2009-10 and subsequent budgets for this project.

Section 2. That the revenue in the following account of Fund No. 3230, the Equipment Capital Lease Acquisition Fund, is hereby estimated in the following amount: 

 AL-3230-120000-583000 Reimbursement from Bank or Lease Co. $600,000.00

Section 3. That the sum of $600,000.00 is hereby appropriated from the Unappropriated Fund Balance of Fund No. 3230, the Equipment Lease Capital Acquisition Fund, to the following account:

AL-3230-577500-B MCI Jackson County $600,000.00


Section 4. That the City Manager is hereby designated as requisitioning authority for Account No. AL-3230-577500.

Section 5. That the City expects to make capital expenditures in connection with the acquisition, construction, improvement and equipping of a regional jail and hereby declares its official intent to reimburse itself for certain expenditures made within 60 days prior to or on and after the date of this ordinance with the proceeds of bonds, notes or a lease purchase agreement. The maximum principal amount of obligations expected to be financed for the project is $600,000.00. This constitutes a declaration of official intent under Treasury Regulation 1.150-2.

Section 6. That the City states its intent to replace at least 60% or $900,000.00 of the funding provided by the public safety sales tax for the regional jail project with other City resources by April 30, 2010.

Section 7. That the City Manager is hereby authorized to execute, on behalf of the City a $1,950,000.00 emergency contract with The Konrath Group, LTD for construction services for Project No. 57000150 Jackson County Detention Center. A copy of the contract is on file in the Capital Improvements Management Office.

 

Section 8. That the City Manager is hereby authorized to amend this contract and to increase the amount of the contract in an amount not to exceed $150,000.00 without further City Council approval.

 

Section 9. That the City Manager is authorized to expend the sum of $2,100,000.00 from funds previously appropriated to Account No. 10-2320-577500 and AL-3230-577500.

 

Section 10. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement, is recognized as an emergency measure within the provisions of Section 503 of the City Charter and shall take effect in accordance with that section.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
