RESOLUTION NO. 990583
Approving
an amendment to the Oak Park South Area Plan by amending the Proposed Land Use
Plan and Map for an area generally located between Brush Creek Boulevard and
Blue Parkway, Kensington Avenue and Elmwood Avenue, to recommend retail/office
uses instead of mixed uses (planned office/retail/residential).
WHEREAS,
the Oak Park South Area Plan was approved by the City Council by Resolution No.
48098, adopted August 18, 1977, as a guide for future development and redevelopment
of the area generally located between 39th Street and Leeds Trafficway on the
north, Brush Creek Boulevard and Blue Parkway on the south, Troost Avenue on
the west, and the Blue River on the east; and
WHEREAS,
the Oak Park South Area Plan was amended on June 1, 1989, by Resolution No.
63217; and
WHEREAS,
the Oak Park South Area Plan was amended again on March 26, 1992, by Resolution
No. 920133, amended on June 30, 1994, by Resolution No. 940643 and was further
amended on June 5, 1997, by Resolution No. 970571; and
WHEREAS,
after further review by the City Development Department it has been deemed
appropriate to amend the Oak Park South Area Plan as it affects that area
generally located between Brush Creek Boulevard and Blue Parkway, Kensington
Avenue and Elmwood Avenue, to modify the Proposed Land Use Plan and Map for
such area from mixed uses (planned office/retail/residential) to
retail/office uses; and
WHEREAS,
public notice of a hearing before the City Plan Commission was published on
December 21, 1998; and
WHEREAS,
the City Plan Commission considered such amendment to the Proposed Land Use
Plan and Map on January 5, 1999; and
WHEREAS,
after all interested persons were given an opportunity to present testimony,
the City Plan Commission did on January 5, 1999, recommend approval of the
proposed amendment to the Oak Park South Area Plan; NOW, THEREFORE,
BE
IT RESOLVED BY THE COUNCIL OF KANSAS CITY:
Section
A. That the fifth amendment to the Oak Park South Area Plan is hereby approved
as to the Proposed Land Use Plan and Map for that area generally located
between Brush Creek Boulevard and Blue Parkway, Kensington Avenue and Elmwood
Avenue, by modifying the recommended land uses for the area from mixed uses
(planned office/retail/residential) to retail/office uses. A copy of the
fifth amendment to the Land Use Plan and Map of the Oak Park South Area Plan is
attached hereto as Exhibit A and incorporated herein by reference.
Section
B. That the Oak Park South Area Plan and this amendment is consistent and
complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by
Committee Substitute for Resolution No. 971268, and is adopted as a supplement
to the FOCUS Kansas City Plan.
