ORDINANCE NO. 030170

 

Approving a Community Unit Project on an approximately 70.2 acre tract of land generally located on the east side of State Line Road, between Blue Ridge Boulevard and 135th Street. (7260-CUP-172)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 70.2 acre tract of land generally located on the east side of State Line Road, between Blue Ridge Boulevard and 135th Street, and more specifically described as follows:


 

All that part of the North One-Half of the Fractional Section 19, Township 47, Range 33, Kansas City, Jackson County, Missouri, being described as follows: Beginning at the intersection of the south line of Blue Ridge Boulevard, as now established, with the east line of the North One-Half of said Fractional Section 19; thence South 03E39'20" West, along said east line, 2566.59 feet to a point on the north line of Missouri State Highway No. 150, as now established; thence North 84E09'21" West, along said north line, 1030.11 feet; thence North 0E1019 East, 1057.19 feet; thence North 87E0147 East, 63.45 feet; thence northerly, along a curve to the right, having an initial tangent bearing of North 09E5025 West, a radius of 250.00 feet, a central angle of 09E1559, an arc distance of 40.43 feet; thence North 0E34'26" West, 779.04 feet; thence North 89E33'44" West, 388.36 feet; thence North 45E30'13" West, 115.89 feet; thence North 0E31'19" East, 609.07 feet to a point on the aforementioned south line of Blue Ridge Boulevard; thence South 85E50'30" East, along said south line, 1603.02 feet to the point of beginning. Containing 70.20 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer construct any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 


5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer extend water mains as required by the Water Services Department.

 

7. That the developer extend sanitary sewers as required by the Department of Public Works.

 

8. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

9. That the developer secure the approval of the Missouri Department of Transportation prior to working within any State right of way.

 

10. That the developer extend the covenants, declarations and restrictions.

 

11. That the developer construct sidewalks on both sides of Inverness Avenue as required by the Department of Public Works.

 

12. That the developer construct the private streets to public street standards including curb, gutter, streetlights and sidewalks on one side as shown on the preliminary plan as required by the Department of Public Works.

 

13. That the developer contribute $19,670.81 in lieu of parkland dedication for 69 single family lots (69 x 3.7 x 0.006 x $12,856.74) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

14. That the developer secure the approval of the Board of Zoning Adjustment for any subdivision identification signage and for any building setback variances.

 

15. That the developer submit a final plan to the City Plan Commission for all private open space tracts.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 030170, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
