ORDINANCE NO. 030508
Approving
the preliminary plat of Maple Park Extension - Replat of Lots 54 and 55, on an approximately
1.33 acre tract of land generally located at 5528 and 5534 N. Bennington
Avenue. (SD 1035)
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That the preliminary plat of Maple Park Extension - Replat of Lots 54 and
55, on an approximately 1.33 acre tract of land generally located at 5528 and
5534 N. Bennington Avenue, and more specifically described as follows:
All of Lots 54 and 55, Maple Park Extension, a
subdivision in Kansas City, Clay County, Missouri.
is
hereby approved, subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly
known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study to the City Engineers Office for
approval and that the developer make any improvements as required by the City
Engineer's Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
5. That
the developer secure a grading permit from the Department of Codes
Administration prior to beginning any construction activities.
6. That
the developer extend water mains and provide easements as required by the Water
Services Department.
7. That
the developer construct sanitary sewers as required by the Department of Public
Works.
8. That
the 3:1 lot depth to width ratio for the three proposed lots as shown on the
preliminary plat be waived.
9. That
the developer dedicate an additional five feet of right of way for N.
Bennington Avenue as required by the Department of Public works so as to ensure
25 feet of right of way as measured from the centerline of N. Bennington
Avenue.
10. That
the developer enter into a Cooperative Agreement with the Department of Public
Works whereby the developer agrees to contribute $134.00 per frontage foot for
a total of $26,800.00 to the design and construction of N. Bennington Avenue to
residential street standards.
11. That
the developer contribute $252.84 in lieu of parkland dedication for 1 single
family lot (1 x 3.7 x 0.006 x $11,389.05) in satisfaction of Section 66-128 of
the Subdivision Regulations.
12. That
the developer receive variances from the Board of Zoning Adjustment to the
required front and side yard setbacks to allow the existing residence on
proposed Lot 3 to remain prior to approval of the final plat.
A
copy of the preliminary plat is on file in the office of the City Clerk under
Document No. 030508, which is attached hereto and made a part hereof.
Section
B. That the Council finds and declares that before taking any action on the
proposed preliminary plat hereinabove, all public notices and hearings required
by the Subdivision Regulations have been given and had.
