ORDINANCE NO. 990399

 

Approving the First Amendment to the Development Plan submitted by the Jazz District Redevelopment Corporation for an area of land of approximately 30 acres generally bounded by Paseo Boulevard on the west, a line about 300 feet north of 17th Terrace on the north, a line about 405 feet east of Woodland Avenue on the east and 19th Street on the south and authorizing the Director of Finance to enter into a First Supplemental Redevelopment Contract with the Jazz District Redevelopment Corporation. (251-S-8)

 

WHEREAS, the Jazz District Redevelopment Corporation, an urban redevelopment corporation of Missouri, organized under and pursuant to the Urban Redevelopment Corporations Act of 1945, as amended, did file with the City Clerk an application for approval of a Development Plan, which was approved by the Council by Committee Substitute for Ordinance No. 980609 passed June 4, 1998; and

 

WHEREAS, the Jazz District Redevelopment Corporation did file a First Amendment to the Development plan with the City Clerk on February 22, 1999; and

 

WHEREAS, the City Clerk did refer the First Amendment to the City Plan Commission; and

 

WHEREAS, the City Plan Commission did cause notice to be published in the Daily Record, a newspaper doing the City's printing on March 1, 1999, such date being not less than ten (10) days prior to the date set for the hearing; and

 

WHEREAS, the City Plan Commission did hold a public hearing on the First Amendment on March 16, 1999, at which time all interested persons were given an opportunity to be heard; and

 

WHEREAS, the City Plan Commission has made an independent study and investigation of the First Amendment and did recommend approval of the First Amendment and did submit a report on the same, a copy of which is attached hereto and incorporated herein by reference as Exhibit "A"; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the application of the Jazz District Redevelopment Corporation for approval of a First Amendment to the Development Plan, filed with the City Clerk, and amended in accordance with recommendations of the City Plan Commission, is hereby incorporated herein by reference and approved as a First Amendment to the Development Plan as originally approved by Committee Substitute for Ordinance No. 980609, passed June 4, 1998. A copy of the application is on file in the office of the City Clerk under Document No. 990399 which is attached hereto and incorporated herein by reference.

 

Section 2. That the Council finds and declares that good cause has been shown for the approval of the First Amendment to the Development Plan of the Jazz District Redevelopment Corporation and that the findings and declarations made by the Council in Sections 2, 4 and 5 of Committee Substitute for Ordinance No. 980609, with respect to the Development Plan of the Jazz District Redevelopment Corporation, have not been affected by the amendments thereto and equally apply to said Development Plan, as amended.

 

Section 3. That the Council hereby finds and determines that the public convenience and necessity will be served by the Development Plan, as amended.

 

Section 4. That the Director of Finance be, and she is hereby, authorized and directed on behalf of the City to enter into a First Supplemental Redevelopment Contract with the Jazz District Redevelopment Corporation, a copy of which in substantial form is attached hereto as Exhibit "B" and which is hereby incorporated herein by reference.
