ORDINANCE NO. 071201

 

Calling a special election to be held February 5, 2008, for the purpose of presenting a nonbinding question concerning light rail to the voters; authorizing and directing the City Clerk to notify the responsible election authorities of this election; and recognizing this ordinance to be an emergency measure.

 

WHEREAS, Section 2-51, Code of Ordinances, provides that: At any election, held throughout the city, excepting the primary and regular municipal elections established by section 417 of the Charter, at which a binding question is submitted by the city to the voters for their approval or disapproval as provided by law, the council may by ordinance include on the ballot no more than two nonbinding questions to obtain the preference of the voters on those nonbinding questions; provided, however, that such ordinance shall have received the affirmative vote of nine members of the council; and

 

WHEREAS, as a result of an initiative petition the question of repeal of the light rail ordinance adopted by voters in November 2006 will be before the voters; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. Special Election Called. A special election is called and shall be held on Tuesday, February 5, 2008, at which election the nonbinding question of whether planning for a light rail system should continue shall be submitted to the qualified voters of the City for their consideration, as allowed by Section 2-51, Code of Ordinances.

 

Section 2. Ballot title. The ballot title shall be:

Public Transportation / Light Rail Planning

 

Should the Mayor, City Council, and the KCATA continue to develop a comprehensive transportation plan which includes light rail and provides for continued present level funding for the buses and to place on the ballot no later than November of 2008 for voter approval said transportation plan(s).

The voter who desires to vote in favor of this proposition shall place an X in the box opposite Yes. The voter who desires to vote against this proposition shall place an X in the box opposite No.

 

Section 3. Delivery of Ordinance by City Clerk to Election Authorities. That the City Clerk shall deliver certified copies of this ordinance and notice of election to the Board of Election Commissioners of Kansas City, Missouri, Board of Election Commissioners of Clay County, Board of Election Commissioners of Platte County, and the County Clerk of Cass County, which shall be the authority of the respective election authorities of the City to submit this question to the electors of Kansas City as herein provided and to give public notice thereof as provided by law no later than November 27, 2007.

 

Section 4. Election Notice. That the notice of election shall read as follows:

Notice is hereby given that the City of Kansas City has called an election to be held in said City on Tuesday, February 5, 2008, at which election all qualified voters residing within the City of Kansas City, Missouri will be given the opportunity to vote.

 

The official ballot will be in substantially the following form:

CITY OF KANSAS CITY

 

QUESTION _____

 

[Instructions to voters will be supplied by the election authorities]

 

Public Transportation / Light Rail Planning

Section 5. Emergency.
