ORDINANCE NO. 030834

 

Accepting various easements and deeds in Clay County; releasing easements in Clay County; and directing the City Clerk to record the acceptance.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That various easements and deeds in Kansas City, Clay County, executed by the following persons, and which appear of record as the instrument numbers and respective books and pages as follows:

 

1. Standard Utility Easement from HMRE, L.C.C., c/o John F. Lutjen & Associates, Inc., Instrument No. R92102, Book 4129, Page 961;

 

2. Standard Utility Easement from HMRE, L.L.C., c/o John F. Lutjen & Associates, Inc., Instrument No. R92103, Book 4129, Page 965;

 

3. Storm Drainage Easement from One Hundred Eighth Cookingham, Inc., Instrument No. S01735, Book 4192, Page 558;

and described in Exhibit A, which is attached hereto and incorporated herein by reference, all recorded in the office of the Recorder of Deeds for Clay County, Missouri, at Liberty, are hereby accepted. That upon the effective date of this Ordinance, the City Clerk is hereby directed to cause this Ordinance and Exhibit A to be recorded in the office of the Recorder of Deeds for Clay County, Missouri, at Liberty.

 

Section 2. That all that part of the platted Utility Easement across Lots 86 and 87, inclusive, Antioch Gardens Amended Plat, a subdivision in Kansas City, Clay County, Missouri, approved by the Council of Kansas City, Missouri, by Ordnance No. 19770, passed December 9, 1955, described as follows: The south 5 feet of Lot 86 and the north 5 feet of Lot 87, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 3. That the Temporary Easement granted to the City by Document No. N78201, Book 2787, Page 652, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 4. That all that part of the platted Grading Easement across Lots 119 through 124, inclusive, Charleston Harbor Third Plat, a subdivision in Kansas City, Clay County, Missouri, approved by the Council of Kansas City, Missouri, by Ordinance No. 000036, passed January 13, 2000, except the westerly 20 feet of said Lots 121 through 124, and except the following described Tract: Beginning at the northwest corner of said Lot 120; thence south along the east right-of-way line of N. Brighton Avenue to the southwest corner of said Lot 119; thence northeasterly to a point on the common line between said Lots 119 and 120, said point being 50 feet east of, as measured at right angles to, the east right of way line of N. Brighton Avenue; thence northwesterly to a point on the north line of said Lot 120, said point being 20 feet east of the northwest corner thereof; thence west along said north line a distance of 20 feet to the point of beginning, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit claim deed to the present owners, their successors or assigns, as further evidence thereof.
