COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 951368
Approving an amendment to a previously approved Community
Unit Project on a 216 acre tract of land generally located at the southwest
corner of N.E. 76th Street and N. Stark Avenue. (11252-CUP-4)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That an amendment to a previously
approved Community Unit Project on a 216 acre tract of land generally located
at the southwest corner of N.E. 76th Street and N. Stark Avenue, and more
specifically described as follows:
All that part of the Southeast Quarter and all that
part of the Southwest Quarter of Section 15, Township 51, Range 32, Kansas
City, Clay County, Missouri, being bounded and described as follows:
Beginning at the southeast corner of said Southeast Quarter; thence North
88 48'15" West, along the south line of said Southeast Quarter,
2601.04 feet to the southeast corner of said Southwest Quarter; thence
North 88 51'28" West, along the south line of said Southwest Quarter,
2606.28 feet to the southwest corner of said Southwest Quarter; thence
North 0 07'07" East, along the west line of said Southwest Quarter,
1728.55 feet; thence South 87 14'05" East, 33.41 feet; thence North 2
45'55" East, 83.42 feet; thence North 24 35'41" East, 99.81
feet; thence North 19 35'17" East, 752.01 feet to a point on the
north line of said Southwest Quarter; thence South 88 57'08" East, along
said north line, 2286.89 feet; thence South 89 04'40" East, along the
north line of said Southwest Quarter, 2644.25 feet to the point of
beginning. Except that part in the Southwest Quarter deeded for a
cemetery in Book 65 at page 203 in the Clay County Recorder of Deeds.
Containing 311.21 acres, more or less. Except that part on the west,
north and east being used for road right-of-way.
is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations
and that the developer provide a
storm drainage study as part of the submission
of any final plat.
2. That the developer secure the approval of the
Board of Zoning Adjustment for any subdivision identification
signage.
3. That the developer secure approval of the City
Street Naming Committee for all street names.
4. That the developer submit a street tree
planting plan as part of the final plats and secure the approval of
the City Forester for street trees planted on right of way in
front of residential lots, with a copy of such
plan to remain on file in the Office of
City Development.
5. That the developer include a statement on the
final plats prohibiting vehicular access from those lots backing onto
N. Stark Avenue and N.E. 76th Street.
6. That the developer include a statement on the
final plats regarding the required 50 foot landscape buffer strip and
identify the location of the buffer strip on all lots
backing onto N. Stark Avenue and N.E. 76th
Street.
7. That the developer dedicate additional
right-of-way as required to provide a total of 40 feet from
centerline for N.E. 76th Street.
8. That the developer improve the south half of
N.E. 76th Street to arterial street standards.
9. That the developer dedicate additional
right-of-way as required to provide a total of 30 feet from
centerline for N. Stark Avenue.
10. That the developer improve the west half of N.
Stark Avenue to collector street standards.
11. That the developer construct temporary
cul-de-sacs as required by the City Engineer's Office.
12. That the developer contribute to the
I-35/Liberty Corridor Study Improvement Fund if the development site
is included in the study boundaries; such contribution shall
be paid by the developer in cash before
recording any plat included within the
corridor study area at the rate of $238.00 per
single family unit.
13. That the developer dedicate parkland in the
amount of 20.39 acres in satisfaction of Section 66-128, Code of
Ordinances; the developer may dedicate such parkland in
increments provided that the minimum dedication
for 300 lots shall occur prior to the
approval of any plat which would increase the
total number of lots platted to exceed
300.
14. That the developer complete an environmental
audit prior to the dedication of any parkland.
15. That the developer extend water mains as
required by the City Water Services Department.
16. That the developer construct all weather roads
and install fire hydrants prior to construction beyond footings and
foundations.
A copy of said Community Unit Project plan amendment is
on file in the office of the City Clerk under Document No. 951368, which is
attached hereto and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed Community Unit Project hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
