Approving the preliminary plat of Gracemor North on
approximately a 28.8 acre tract of land generally located at N.E. Palmer Drive
at N.E. 56th Street. (SD 0718)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That the preliminary plat of Gracemor
North on approximately a 28.8 acre tract of land generally located at N.E.
Palmer Drive at N.E. 56th Street, and more specifically described as follows:
All that part of the Southwest Quarter of the
Southwest Quarter of Section 27, Township 51 North, Range 32 West
described as follows: Beginning at the southwest corner of said Section
27; thence South 89 23'14" East, along the south line of said Section
27, a distance of 370.00 feet to the point of beginning of the tract of
land herein described; thence South 89 48'25" East, along the south
line of said Section 27, a distance of 918.23 feet; thence North 00
28'48" West, along the east line of the Southwest Quarter of the
Southwest Quarter of said Section 27, a distance of 1,047.93 feet; thence
South 89 58'59" East, a distance of 165.00 feet; thence North 00
28'48" West, a distance of 264.00 feet to a point on the north line of the
Southeast Quarter of the Southwest Quarter of said Section 27; thence
North 89 58'59" West, a distance of 165 feet to the northeast corner
of the Southwest Quarter of the Southwest Quarter of said Section 27;
thence North 89 58'59" West along the north line of the Southwest
Quarter of the Southwest Quarter of said Section 27, a distance of 912.55
feet; thence South 00 13'53" East, a distance of 774.26 feet, said line
and following lines to the point of beginning being the easterly right of
way of Interstate 435; thence South 14 16'03" East, a distance of
103.08 feet; thence South 00 13'53" East, a distance of 100 feet;
thence South 13 48'17" West, a distance of 103.08 feet, thence South
00 13'53" East, a distance of 241 feet to the point of beginning and
also Lot 1, Gracemor 4th Plat, Block 9. Containing 28.79 acres, more or
less, including existing public right of way.
is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study for the entire development to the City Engineer's Office for
approval and that improvements be made as required by
the City Engineer's Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City's Engineer's Office for
approval prior to the commencement of any construction
activities.
4. That the developer secure the approval of the
Street Naming Committee for all streets.
5. That the developer provide for hard surface
roads and provide for fire protection prior to construction beyond
foundations as required by the Fire Department.
6. That the developer extend water mains as
required by the Water Services Department.
7. That the developer secure a land disturbance
permit from the Missouri Department of Natural Resources.
8. That the developer submit a street tree
planting plan with the final plat to the City Forester for approval
and secure the approval of the City Forester for the spacing and
species of trees.
9. That a variance on the lot depth for Lots
11-14, 30, 31 and 81 is hereby granted.
10. That the developer construct N. Richmond Avenue
from the south property line south to N.E. 55th Street to residential
street standards.
11. That the developer construct sidewalks as
required by the Department of Public Works along existing N.E. Palmer
Drive and N.E. 57th Street.
12. That the developer install streetlights as
required by the Department of Public Works along N.E. Palmer Drive
and N.E. 57th Street.
13. That the developer secure approval of the
Missouri Highway and Transportation Department for any work within
State right of way.
14. That the developer pay money in lieu of
parkland dedication in the amount of $20,970.25 for 90 single family
units in satisfaction of Section 66-128 of the
Subdivision Regulations.
A copy of said preliminary plat is on file in the office
of the City Clerk under Document No. 960069, which is attached hereto and made
a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed preliminary plat hereinabove, all
public notices and hearings required by the Subdivision Regulations have been
given and had.
