COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 970175

 

Approving a Community Unit Project on approximately a 198 acre tract of land generally located on the west side of N. Flintlock Road and approximately 4,000 feet north of N.E. Barry Road. (11926-CUP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on approximately a 198 acre tract of land generally located on the west side of N. Flintlock Road and approximately 4,000 feet north of N.E. Barry Road, and more specifically described as follows:

 

A tract of land in the Southwest Quarter of Section 2 and the Southeast Quarter of Section 3, all in Township 51, Range 32, Kansas City, Clay County, Missouri, being described as follows: Commencing at the southeast corner of said Southwest Quarter; thence North 89 24'22" West, along the south line of said Southwest Quarter 1468.55 feet to the true point of beginning of the tract to be herein described; thence continuing North 89 24'22" West, along said south line, 1115.47 feet to the southwest corner of said Southwest Quarter; thence North 88 09'58" West, along the south line of the Southeast Quarter of said Section 3, 1315.39 feet to a point 10.75 feet west of the southwest corner of the East One-Half of said Southeast Quarter; thence North 0 42'14" East, 10.75 feet west of and parallel with the west line of said East One-Half, 2580.53 feet; thence South 88 24'28" East, 20.00 feet south of and parallel with the north line of the Southeast Quarter of said Section 3, 1306.45 feet; thence South 89 30'45" East, 20.00 feet south of and parallel with the north line of the Southwest Quarter of said Section 2, 2581.32 feet to a point on the east line of said Southwest Quarter; thence South 0 29'54" West, along said east line, 1531.04 feet; thence North 89 24'22" West, 1049.33 feet; thence South 0 26'54" West, 185.00 feet; thence North 89 24'22" West, 419.21 feet; thence South 0 26'54" West, 875.00 feet to the true point of beginning. Containing 197.26 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for approval when the first plat is submitted and that the

developer make any necessary improvements as required by the City Engineer's

Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer submit covenants, conditions and restrictions to the Law Department for approval with the final plats for the maintenance of private roadways,

recreation areas and detention areas.

 

5. That the developer dedicate additional right of way for N. Flintlock Road as required by the Department of Public Works so as to provide a total of 40 feet of right of way

as measured from the centerline of N. Flintlock Road.

 

6. That the developer improve the west-half of N. Flintlock Road to secondary arterial street standards as required by the Department of Public Works.

 

7. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

8. That the developer extend water mains as required by the Water Services Department.

 

9. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

10. That the developer submit a street name sign plan to the Street Naming Committee for approval.

 

11. That the developer construct temporary cul-de-sacs as required by the Department of Public Works.

 

12. That the developer submit a street tree planting plan as part of the final plats and secure the approval of the City Forester for street trees planted on right of way in

front of residential lots. The plan shall include size, type, species and placement of

trees.

 

13. That the developer submit no final plats beyond 300 single family units for approval until such time as N. Flintlock Road is improved south to N.E. Barry Road, providing

a minimum of two lanes constructed to City standards, as required by the City

Engineer's Office.

 

14. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 970175, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
