ORDINANCE NO. 110637

 

Detaching from the City approximately 5.37 acres generally located west of Missouri Route A, north of N.E. 104th Street and south of N.E. 112th Street. (100-AN-10)

 

WHEREAS, Mr. Shane Fleshman owns a 22.08 acre tract of land of which 5.37 acres is within Kansas City, Missouri, and the remaining 16.71 acres is within unincorporated Clay County; and

 

WHEREAS, on January 1, 1962, Ordinance No. 20190 became effective which annexed land from unincorporated Clay County into the City of Kansas City, Missouri and split the 22.01 acre tract between the 5.37 acre portion now in Kansas City and the 16.71 acre portion in unincorporated Clay County; and

 

WHEREAS, existing Kansas City sanitary sewer and water mains are about 4,000 feet from the subject 5.37 acre portion; and

 

WHEREAS, the City of Kansas City has determined that providing basic services to property generally located west of Missouri Route A, north of N.E. 104th Street and south of N.E. 112th Street is an inefficient use of City funds; and

 

WHEREAS, the owner has petitioned that all of the 22.08 acre property be located within one governmental entity; and

 

WHEREAS, the City of Kansas City and Clay County agree that providing basic services to property generally located west of Missouri Route A, north of N.E. 104th Street and south of N.E. 112th Street is better addressed by a single governmental entity; and

 

WHEREAS, it is the intent of the City of Kansas City to deannex 5.37 acres generally located west of Missouri Route A, north of N.E. 104th Street and south of N.E. 112th Street according to the terms of Section 71.011, Revised Statutes of Missouri; and

 

WHEREAS, notice of this detachment has been published in a newspaper of general circulation at least seven days prior to the hearing on this matter; and 

 

WHEREAS, there are no residents living in the area to be detached; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the following property, generally located west of Missouri Route A, north of N.E. 104th Street and south of N.E. 112th Street and more specifically described as follows: 

 

A tract of land in the South Half of the Northeast Quarter of Section 25, Township 52 North, Range 32 West of the 5th Principal Meridian in City of Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the Southeast corner of said Northeast Quarter; thence North 89 degrees 45 minutes 41 seconds West, along the South line of said Northeast Quarter, 42.50 feet to a point of the West right-of-way line of Missouri Route A, as now established ; thence continuing North 89 degrees 45 minutes 41 seconds West, along said South line, 161.59 feet to the point of beginning of the tract of land to be herein described; thence continuing North 89 degrees 45 minutes 41 seconds West, along said line, 1,300.00 feet; thence North 00 degrees 21 minutes 21 seconds East, parallel with the East line of said Northeast Quarter, 180.00 feet; thence South 89 degrees 45 minutes 41 seconds East, 1,300.00 feet; thence South 00 degrees 21 minutes 21 seconds West, parallel with the East line of said Northeast Quarter, 180.00 feet to the point of beginning. Containing 234,000 square feet or 5.37 acres, more or less.

 

is hereby declared to be detached from the City of Kansas City, Missouri.

 

Section 2. That the reasons for and purposes to be accomplished with this detachment by the City of Kansas City are that it will allow for better coordination of utility service and better provision of services for the benefit of the citizens and property owners in the affected area.
