ORDINANCE NO. 971016

 

Authorizing the Director of Finance to execute a Special Warranty Deed releasing any interest the City may have in land located in that portion of Elmwood Avenue (new Marion Park Drive) located in Kansas City, Jackson County, Missouri, to the Missouri Highway and Transportation Commission and directing the Director of City Development to record same.

 

WHEREAS, the City desires to release any and all claims which it might have to such street right of way; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Finance of Kansas City, Missouri, is hereby authorized to execute a Special Warranty Deed releasing to the Missouri Highway and Transportation Commission, any right or interest which the City may have in and to the following tract of land located in Kansas City, Jackson County, Missouri:

 

All that part of grantor's real property and real property rights and interest located in Elmwood Avenue in Kansas City, Jackson County, Missouri, located in the Southwest Quarter of Section 26, Township 48 North, Range 33 West, (including that portion of the original Lot 1 of Showbiz Pizza Place, a subdivision in Kansas City, Jackson County, Missouri, dedicated as street right of way by Document No. K-902343 recorded in Book K-1970 at page 986), lying on the right or southerly side of the following described route west centerline, to-wit: Beginning at a point on the existing southerly right of way line 52.09 feet right of Station 221+67.42; thence southeasterly along the existing southerly right of way line to a point 61.62 feet right of Station 222+46.81; thence southerly to a point 75.09 feet right of Station 222+47.21; thence southwesterly to a point 80 feet right of Station 222+30.11; thence westerly to a point 80 feet right of Station 221+68.26; thence northerly to a point of beginning; containing 0.05 of an acre, more or less, of new land.

 

The Route W (Bannister Road) centerline is located and described as follows: Beginning at the northwest corner of the Southwest Quarter of Section 26, Township 48 North, Range 33 West; thence South 3 21'52" West a distance of 3.6 feet to a point on said centerline at Station 208+56.9; thence the centerline extends South 86 38'08" East a distance of 1422.52 feet to Station 222+79.42.

 

Also, all abutter's rights of direct access between the highway now known as Route W (Bannister Road), and grantor's abutting land in Elmwood Avenue, in Kansas City, Jackson County, Missouri, located in the Southwest Quarter of Section 26, Township 48 North, Range 33 West, (including that portion of the original Lot 1 of Showbiz Pizza Place, a subdivision in Kansas City, Jackson County, Missouri, dedicated as street right of way by Document No. K-902343 recorded in Book K-1970 at page 986); except that there is reserved and excepted a grantor, its successors and assigns the usual right of direct access (a) to any adjacent outer roadway if and while it may be maintained by proper authority in front of such land (b) along it to and from the nearest lane of the thruway or public highway, and (c) at all times when no outer roadway is being so maintained, there is reserved and excepted to grantor the right of direct access to the nearest lane of the thruway over a 136-foot entrance to be centered at the southerly right of way line opposite Station 221+144. The cost of constructing said entrance shall be borne by grantor and shall be in accordance with a permit issued by the Commission on application by grantor, its successors, or assigns.

 

Grantee shall obtain all rights, privileges, appurtenances and immunities belonging to Grantor, successors and assigns forever.

 

Section 2. That the Director of City Development is hereby directed to record the deed and a copy of this ordinance in the Office of the Recorder of Deeds for Jackson County, Missouri.
