COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 980178

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0122, rezoning an area of approximately 6.56 acres generally located at the northwest corner of Missouri Highway 152 and N. Oak Trafficway from District RA (Agricultural) to District CP-2 (Local Planned Business Center), and approving a preliminary plan for the same. (12009-CP-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0122, rezoning an area of approximately 6.56 acres generally located at the northwest corner of Missouri Highway 152 and N. Oak Trafficway from District RA (Agricultural) to District CP-2 (Local Planned Business Center), said section to read as follows:

 

Section 80-11A0122. That an area legally described as:

 

A tract of land in the East One-Half of the Northwest Quarter of Section 2, Township 51, Range 33, Kansas City, Clay County, Missouri, being described as follows: Commencing at a point on the west line of the East One-Half of the Northwest Quarter of said Section 2, said point being 473.98 feet north of the southwest corner thereof; thence South 8933'13" East, 828.16 feet to the true point of beginning of the tract to be herein described; thence North 1703'14" West, 206.96 feet; thence North 0103'35" East, 354.38 feet; thence northeasterly on a curve to the left, having an initial tangent bearing of North 6836'13" East, a radius of 350.00 feet, an arc distance of 61.44 feet; thence North 6056'23" East, 231.92 feet; thence northeasterly on a curve to the right, tangent to the last described course, having a radius of 254.00 feet, an arc distance of 130.64 feet; thence South 8935'31" East, 148.13 feet to its intersection with the centerline of Missouri State Highway No. 169; thence South 021'52" West, along said centerline, 217.48 feet; thence South 8949'12" West, 67.73 feet to a point on the westerly line of N. Oak Trafficway, as now exists; thence South 1000'45" West, along said westerly line, 452.16 feet to its intersection with the northerly right of way line of Missouri Route 152, as now exists; thence South 7939'08" West, along said northerly right of way line, 334.55 feet to the true point of beginning. Containing 6.56 acres, more or less.

 

is hereby rezoned from District RA (Agricultural) to CP-2 (Local Planned Business Center), all as shown outlined on a map marked Section 80-11A0122, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 


Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineers Office for approval and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to any construction beyond foundations.

 

5. That the developer extend water mains as required by the Water Services Department.

 

6. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

7. That the developer extend and construct sanitary sewers as required by the Department of Public Works.

 

8. That the developer secure the approval of the Missouri Highway and Transportation Department prior to working in any State right of way.

 

9. That the developer enter into a Cooperative Agreement with the City as required by the Department of Public Works whereby the developer agrees to contribute to the cost of constructing a traffic signal at N.E. 94th Street and N. Oak Trafficway in an amount not to exceed $60,000.00.

 

10. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping, grading and signage.

 

A copy of said preliminary plan is on file in the office of the City Clerk under Document No. 980178, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
