ORDINANCE NO. 140441

 

Approving the First Amended and Restated Troost Rockhill PIEA General Development Plan on about 20 acres generally bounded by E. 65th Street on the north, E. 68th Street on the south, parts of Rockhill Road on the west and Troost Avenue on the east, and declaring that area a blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Missouri Planned Industrial Expansion Authority (PIEA) Law 100.300-100.620. (683-S-1)

 

WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri did prepare or cause to be prepared the First Amended and Restated Troost Rockhill PIEA General Development Plan and on February 14, 2014, recommended that the Council approve the finding of blight and approve the General Development Plan for the area; and

 

WHEREAS, the City Plan Commission has reviewed and recommended approval of the finding of blight and of the First Amended and Restated Troost Rockhill PIEA General Development Plan on April 15, 2014; and

 

WHEREAS, the City Plan Commission has found said plan to be in conformance with the general plan for the development of the community as a whole;  

 

WHEREAS, Section 100.400, RSMo, authorizes the Council to approve a general development plan and a designation of blight if the Council finds that the plan is feasible and in conformity with the general plan for the development of the community as a whole; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council declares the area of approximately 20 acres generally bounded by E. 65th Street on the north, E. 68th Street on the south, parts of Rockhill Road on the west and Troost Avenue on the east, and more specifically described as follows:

 

Beginning at the northeast corner of Tract A, Baptist Medical Center, Second Plat, a subdivision in the City of Kansas City, Jackson County, Missouri; thence coincident with the East line of said Tract A along the following courses: South 02 degrees 22 minutes 56 seconds West a distance of 304.89 feet; thence North 86 degrees 43 minutes 17 seconds West, 117.81 feet; thence South 02 degrees 22 minutes 42 seconds West, 255.27 feet; thence departing the east line of said Tract A, east along the South line of Lot 1, Dialysis Clinic Incorporated – First Plat, a subdivision in Kansas City, Jackson County, Missouri, parallel with the North line of the Southeast 1/4 of the Northeast 1/4 of the Southeast 1/4 of the Southeast 1/4 of Section 5, Township 48, Range 33, in Kansas City, Jackson County, Missouri, a distance of 127.27 feet; thence North along the East line of said Lot 1, Dialysis Clinic Incorporated – First Plat, a subdivision in Kansas City, Jackson County, Missouri , a distance of 192.75 feet to a point 62.50 feet South of the North line of said 1/4 1/4 1/4 1/4 Section; thence East and parallel to the North line of said 1/4 1/4 1/4 1/4 Section a distance of 157.39 feet to a point on the west right-of-way line of Troost Avenue, as now established; thence south along said west right-of-way line of Troost Avenue, as now established, to a point which is 689.39 feet North of the South line of the East one-half of the Northeast Quarter of the Northeast Quarter Section; thence Southerly and Southwesterly along the Northerly line of 68th Street, as now established, being a curve to the right from the last described course, as a tangent, having a radius of 50 feet, a distance of 62.75 feet, thence continuing Southwesterly and Westerly, along said Northerly line, being a curve to the right, having a common tangent with the last described curve, and a radius of 666.8 feet, a distance of 211.42 feet; thence continuing Westerly and Northwesterly along said Northerly line, being a curve to the right, having a common tangent with the last described curve, and a radius of 322.10 feet, a distance of 177.62 feet to an intersection, with a line drawn parallel with and 205 feet East of the West line of said East one-half of the Northeast Quarter of the Northeast Quarter Section, measured parallel with the North line thereof; thence North, along said parallel line, 420.09 feet to an intersection with a line drawn parallel with and 250 feet South of the North line of said East one-half of the Northeast Quarter of the Northeast Quarter Section, measured parallel with the West line thereof; thence North 86 degrees 43 minutes 43 seconds West, along said parallel line, the South line of Tract A, Baptist Medical Center, Second Plat, a subdivision in Kansas City, Jackson County, Missouri, a distance of 29.79 feet; thence South 02 degrees 19 minutes 33 seconds West continuing along said South line, a distance of 118.50 feet; thence North 86 degrees 43 minutes 43 seconds West, continuing along said South line, a distance of 150.00 feet; thence North 02 degrees 19 minutes 53 seconds East, continuing along said South line, a distance of 368.50 feet, to a point on the North line of the Northeast quarter of Section 8, Township 48, Range 33; thence South 86 degrees 43 minutes 13 seconds East, along said North line, a distance of 319.79 feet; thence North 02 degrees 12 minutes 17 seconds East, 345.57 feet; thence North 86 degrees 43 minutes 13 seconds West, 118.32 feet; thence along a non-tangent curve to the left, coincident with the West line of said Tract A, 8.63 feet, said curve has a radius of 552.00 feet and a chord bearing North 32 degrees 19 minutes 43 seconds East, 8.63 feet to a point of a tangent compound curve; thence along said curve, to the left, coincident with the West line of said Tract A, 181.26 feet, said curve has a radius of 392.60 feet and a chord bearing North 18 degrees 39 minutes 17 seconds East, 179.66 feet to a point of non-tangent curve, as platted; thence along said non-tangent curve to the left, coincident with the West line of said Tract A, 100.00 feet, said curve has a radius of 540.00 feet and a chord bearing North 07 degrees 40 minutes 44 seconds East, 99.85 feet; thence North 02 degrees 22 minutes 26 seconds East, coincident with the West line of said Tract A, 162.51 feet to a point of curvature; thence along a curve to the right, coincident with the West line of said Tract A, 63.46 feet, said curve has a radius of 40.00 feet and a chord bearing North 47 degrees 49 minutes 34 seconds East, 57.01 feet to the North line thereof; thence North 86 degrees 43 minutes 17 seconds East, coincident with the North line of said Tract A, 365.03 feet to the point of beginning, except the following described tract:

 

All that part of the East half of the Northeast Quarter of the Northeast Quarter of Section 8, Township 48, Range 33, in Kansas City, Jackson County, Missouri, described as follows: Beginning at a point on the West line of Troost Avenue, as now established, 689.39 feet North of the South line of said East one-half of the Northeast Quarter of the Northeast Quarter Section, which point is on the Northerly line of 68th Street, as now established; thence Southerly and Southwesterly along a curve to the right from the West line of said Troost Avenue, as a tangent, having a radius of 35.50 feet, a distance of 44.55 feet; thence Southwesterly, along a line tangent to the last described curve, 13.79 feet; thence Southwesterly and Westerly along a curve to the right, from the last described course as a tangent, having a radius of 656.80 feet, a distance of 208.25 feet, thence Westerly and Northwesterly along a curve to the right, having a common tangent with the last described curve and a radius of 312.10 feet, a distance of 177.09 feet; thence Northwesterly, along a curve to the left, having a common tangent with the last described curve and a radius of 160.00 feet, a distance of 1.20 feet to an intersection with a line drawn parallel with and 205 feet East of the West line of said East one-half of the Northeast Quarter of the Northeast Quarter Section, measured parallel with the North line thereof, thence South, along said parallel line 11.82 feet to a point on the Northerly line of said 68th Street, thence Southeasterly, Easterly, and Northeasterly, along said Northerly line to the point of beginning.

 

to be a blighted, insanitary or undeveloped industrial area in need of industrial development as defined in Section 100.310, RSMo, which constitutes an economic or social liability or a serious and growing menace, which is injurious to the public health, safety, morals, economy and welfare of the residents of Kansas City, and finds that the elimination or prevention of the detrimental conditions in such area by the commercial development of such area is necessary and in the interest of the public health, safety, morals, economy and welfare of such residents. 

 

Section 2. That the First Amended and Restated Troost Rockhill PIEA General Development Plan being that area of approximately 20 acres generally bounded by E. 65th Street on the north, E. 68th Street on the south, parts of Rockhill Road on the west and Troost Avenue on the east, is hereby approved. A copy of said plan is attached to this ordinance and is made a part hereof.  

 

Section 3. That the Council has duly made the findings necessary for compliance with Section 100.300-100.620, RSMo. 

 

Section 4. That said General Development Plan is hereby found to be feasible and in conformance with the general plan for the development of the community as a whole. 

 

Section 5. That the ad valorem tax exemption benefits as authorized in Section 100.570, RSMo, are hereby extended to the plan area to the extent and in the manner as provided for in said General Development Plan, and subject to the execution of a development agreement with Planned Industrial Expansion Authority of Kansas City, Missouri, and the developer.
