ORDINANCE NO. 031213

Accepting an easement in Jackson County; releasing easements in Jackson County; and directing the City Clerk to record the acceptance.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That various easements and deeds in Kansas City, Jackson County, executed by the following person, and which appear of record as the instrument number and respective book and page as follows:

 

1. Permanent Sewer Easement from Planned Industrial Expansion Authority, Instrument No. 2003K0053496.

 

and described in Exhibit A, which is attached hereto and incorporated herein by reference, all recorded in the office of the Recorder of Deeds for Jackson County, Missouri, at Kansas City, are hereby accepted. That upon the effective date of this Ordinance, the City Clerk is hereby directed to cause this Ordinance and Exhibit A to be recorded in the office of the Recorder of Deeds for Jackson County, Missouri, at Kansas City.

 

Section 2. That the following part of the retained Utility Easement of the vacated Henning Street (as vacated by Ordinance No. 37316 on 9-26-1907) described as follows: All that part of Henning Street from the north right-of-way of Eighth Street to the south right-of-way of Railroad Street, lying between Blocks 6 and 4 of Coates and Hopkins Addition, is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 3. That the following part of the retained Utility Easement of the vacated Henning Street (as vacated by Ordinance No. 37316 on 9-26-1907) described as follows: All that part of Henning Street from the north right-of-way of Railroad Street to the northerly line of Blocks 7 and 3, Coates and Hopkins Addition, lying between Blocks 7 and 3 of Coates and Hopkins Addition, is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 4. That the following certain part of the retained Utility Easement of the vacated Railroad Street (as vacated by Ordinance No. 030653 on 6-12-2003) described as follows: All that part of Railroad Street from the westerly line of Blocks 6 and 7, Coates and Hopkins Addition, easterly to the westerly right-of-way line of vacated Hopkins Street (as vacated by Ordinance No. 37316 on 9-26-1907), is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit claim deed to the present owners, their successors or assigns, as further evidence thereof.

Section 5. That the following part of the retained Utility Easement of the vacated Jarboe Street (as vacated by Ordinance No. 15534 on 4-28-1952) described as follows: All that part of Jarboe Street from the northerly right-of-way of Eighth Street to the southerly right-of-way of Railroad Street, lying within Block 4, Coates and Hopkins Addition, and to the west of relocated Jarboe Street, as established by Ordinance No. 15286 on 2-4-1952, is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit claim deed to the present owners, their successors or assigns, as further evidence thereof.
