ORDINANCE NO. 910759

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2392, rezoning certain property generally bounded by 33rd Street, 34th Street, Prospect and Montgall from District R-5 (High Apartment) to District PD/R-5 (Planned District/High Apartment), and approving a development plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance is hereby amended by enacting a new section to be known as Section 65.010A2392, rezoning certain property generally bounded by 33rd Street, 34th Street, Prospect and Montgall from District R-5 (High Apartment) to District PD/R-5 (Planned District/High Apartment), said section to read as follows:

 

Section 65.010A2392. That an area legally described as:

 

Beginning at the intersection of the north right of way line of 34th Street and the east right of way line of Prospect Avenue; thence northerly along the east right of way line of Prospect Avenue, a distance of 379 feet to a point on the west lot line of Lot 5, JOHN A. MOORE'S FIRST SUBDIVISION; thence easterly along a line 10 feet south of and parallel to the north lot line of said Lot 5, JOHN A. MOORE'S FIRST SUBDIVISION, a distance of 134 feet, to the point of intersection with the east lot line of said Lot 5, JOHN A MOORE'S FIRST SUBDIVISION; thence southerly along the west lot line of Lots 5 and 6, JOHN A. MOORE'S FIRST SUBDIVISION, a distance of 90 feet to the point of intersection with the south lot line of said Lot 6; thence easterly along the north lot line of Lot 8, JAMES T. ROBINSON'S 1ST ADDITION, a distance of 131 feet to the point of intersection with the west right of way line of Montgall Avenue; thence south along the west right of way line, a distance of 290.3 feet to the point of intersection with the north right of way line of 34th Street; thence westerly along the north right of way line of 34th Street, a distance of 265 feet to the point of beginning; now all include in and part of Kansas City, Jackson County, Missouri and Palestine Gardens, a subdivision in Kansas City, Jackson County, Missouri.

 

is hereby rezoned from District R-5 (High Apartment) to District PD/R-5 (Planned District/High Apartment), all as shown outlined on a map marked Section 65.010A2392, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a development plan for the area legally described is hereby approved. A copy of said development plan is on file in the office of the City Clerk under Document No. _______ which is attached hereto and made part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
