COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 180170

 

Appropriating $153,674.00 from the Unappropriated Fund Balance of the Sewer Special Assessment Bond Fund; authorizing a $558,812.00 construction contract with Site Rite Construction Company, Inc., for the N.W. 55th Street and N.W. Flintridge Road Sanitary Sewer Extension project; authorizing a maximum expenditure of $614,696.00; assessing the properties benefited; and recognizing this ordinance as having an accelerated effective date.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the sum of $153,674.00 is appropriated from the Unappropriated Fund Balance of the Sewer Special Assessment Bonds 1996 Fund to the following account in the Sewer Special Assessment Bonds 1996 Fund:

 

AL-3210-807170-B-89003618 Infill Sewer Projects $153,674.00

 

Section 2. That the Director of Water Services is authorized to execute Contract No. 1381 in the amount of $558,812.00 with Site Rite Construction Company, Inc. for the N.W. 55th Street and N.W. Flintridge Road Sanitary Sewer Extension project, Project No. 89003618.  A copy of this contract is on file in the office of Water Services.

 

Section 3. That the Director of Water Services is authorized a maximum expenditure of $614,696.00, from Account Nos. AL-3210-807170-B-89003618, ($153,674.00), Infill Sewer Projects, 18-3090-808208-B-89003618 ($153,674.00), Water & Sewer NC2, and 18-8110-807170-B-89003618 ($307,348.00), Infill Sewer Projects, to satisfy the cost of this contract.

 

Section 4. That the special assessments for 50% of total construction cost of the sewer extension plus 25% of the total construction cost of the sewer extension for engineering and administration less amount approved for Project No. 89003618 from the Public Improvement Sales Tax Fund are hereby authorized to be made and levied upon the benefited properties within Sewer District Nos. 15105 through 15108 according to the provision of Article II, Division II, Section 60-44. “Rules for apportioning assessments”, and Section 60-45. “Cost of district sewers, how apportioned”, all in Chapter 60, Code of Ordinances of Kansas City, relating thereto. Special tax bills evidencing the amount of such assessments shall be issued to Kansas City, and, when collected, shall be credited to the Sewer Special Assessment Fund. All or any portion of the assessment may be paid without interest within sixty days from the date the notice of assessment was issued. If the assessment is not paid in full within sixty (60) days, the assessment shall bear interest starting sixty days after the date the notice of assessment was issued. The interest shall accrue at a rate per annum equal to the rate on the Ten-Year U.S. Treasury Note Constant Maturity Index as of May 1 in the fiscal year the notice of assessment was issued, or five (5) percent, whichever rate is greater. If the assessment is not paid in full during the sixty-day period as provided in this section, the unpaid principal shall be payable with interest in fifteen annual installments. Interest shall continue until the assessment is paid in full. The first annual installment shall be billed 180 days after the date the notice of assessment is issued and shall be due and payable within 30 days of billing. Each annual installment shall be billed on the same day and month as the first annual installment. If any installment is not paid when due, the installment shall be delinquent and the assessment shall be in default. Once the assessment is in default, all of the remaining unpaid installments shall immediately become due and collectible, and a penalty shall be assessed equal to one-half percent per month of the full principal balance for each month that the assessment remains unpaid, with a maximum penalty of twenty-five percent, all according to the provision of Article XI, Division 5, Section 2-1721 “Payment of special assessments and special tax bills; installment payments” Code of Ordinances of Kansas City, relating thereto.

 

Section 5. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement, is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(D) of the City Charter and shall take effect in accordance with Section 503, City Charter.
