Approving a UR development plan/preliminary plat for 290 acres generally bounded by 87th Street on the north, Bannister Road on the south, the Kansas City Southern Railroad tracks on the east and I-435 on the west, to allow for a mixed use development that includes 4.5 million square foot of office and 400,000 square foot of retail/commercial. (6720-UR-16).

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a development plan (which replaces a previously approved plan), which will also serve as a preliminary plat, in District UR is hereby approved for approximately 290 acres generally bounded by 87th Street on the north, Bannister Road on the south, the Kansas City Southern Railroad tracks on the east and I-435 on the west, more specifically described as follows:

 

Section 88-20A0968. That an area legally described as:

 

A portion of Sections 23, 24, 25, & 26, all in Township 48 North, Range 33 West in the city of Kansas City, Jackson County, Missouri

Section B. That the development plan approved herein is subject to the following conditions:

 

1.                  That the remaining 117 acre area within the existing Three Trials URD will remain subject to the existing UR plan until a new plan is approved for that area. The developer will provide a graphic depiction and a detailed summary table of the parcels, areas and phases, within the existing Tree Trails URD plan that are not included in the plan area approved herein.

 

2.                  That the developer submit a final plan to the Director of City Development for approval, indicating plans for landscaping, grading, detailed internal circulation, signage, lighting and a photometric study showing zero footcandles at the property lines prior to issuance of building permit. The final UR plans should incorporate the HMAP design guidelines wherever the opportunity presents itself. These guidelines include trails, transit and walkability recommendations, roadway recommendations, housing strategies, urban design (locations of gateways and streetscape improvements), and open space/stormwater management recommendations.

 

3.                  That the developer cause the area to be platted and processed in accordance with Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, as amended.

 

4.                  That the developer submit a detailed macro/micro storm drainage study showing compliance with the approved and most current macro study on file with the City and with current adopted standards in effect at the time of submission, including a detailed analysis and design of the permanent water quantity and water quality BMP's. conveyance systems and sewer services, prior to approval and issuance of any building permits to construct improvements on the site; that the developer verify and/or improve downstream conveyance systems or address solutions for impacted properties due to flow contributions from the site; and that the developer construct any other improvements as required by the Land Development Division as necessary to mitigate impacts from rate, volume and quality of runoff from the proposed site.

 

5.                  That the developer pay impact fees as required by Chapter 39 of the City's Code of Ordinances, as required by the Land Development Division.

 

6.                  That the developer submit a letter to the Land Development Division from a licensed civil engineer, licensed architect, or licensed landscape architect, who is registered in the State of Missouri, stating the conditions of the sidewalks, curbs, and gutters. The letter must identify areas that are out of repair as defined by Public Works Department in "OUT OF REPAIR CRITERIA FOR SIDEWALK, DRIVEWAY AND CURB Revised 4/8/09" standards and in Chapters 56 and 64, Code of Ordinances, for the sidewalks, curbs, and gutters. It shall identify the quantity and location of sidewalks, curbs, and gutters that need to be constructed, repaired, or reconstructed to remedy deficiencies and to remove existing approaches no longer needed by this project. The developer shall secure permits to repair or reconstruct the identified sidewalks, curbs, and gutters as necessary along all development street frontages as required by the Land Development Division and prior to recording the plat or obtaining Building Permits, whichever occurs first.

 

7.                  That the developer grant, on City approved forms, BMP Easements to the City, as required by Chapter 88 and Land Development Division, prior to issuance of any building permits or BMP permits, whichever occurs first.

 

8.                  That after the City Plan Commission enters its disposition for the development plan, the developer shall not enter into any agreement that would encumber or otherwise have any impact on the proposed right of way dedications for the planned project without the prior written consent of the Land Development Division.

 

9.                  That the owner/developer verify adequate capacity of the existing sewer system as required by the Land Development Division for the property and address any inadequacies therein prior to issuance of connection authorization and/or issuance of any temporary certificate of occupancy (TCO).

 

10.              That the owner/developer secure a site disturbance permit from the Land Development Division prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more during the life of the construction activity.

 

11.              That the APWA 5600 Stream Buffer Zone boundary be shown and labeled on the final plat and construction plans. If applicable to project, a stand-alone stream buffer easement shall be recorded in the Jackson County Recorder's Office and be submitted along with stand alone stream buffer plans to LDD at 5th Floor of City Hall, as required by the Land Development Division.

 

12.              That the developer submit plans for grading, siltation and erosion control to the Land Development Division for approval prior to beginning any construction activities, clearing or grubbing activities, if the disturbed area equals one acre or more during the life of the construction activity.

 

13.              That the developer secure permits to extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by Development Services, prior to recording the plat.

 

14.              That the developer secure permits to provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by Development Services, prior to recording the plat.

 

15.              That the developer submit covenants, conditions, and restrictions to the Law Department for approval by the City for the maintenance of any detention areas and enter into a covenant agreement for the maintenance of any stormwater detention area tracts, with each final plat.

 

16.              That the developer submit public improvement plans, including intersection improvements, public streets and storm sewers, sanitary sewers, streetlights, road markings, sidewalk, curb and gutter and drive approaches, as applicable, to address all above items, direct to the Land Development Division for code compliance review and obtain all required construction permits from the Land Development Division.

 

17.              That the developer relocate and privatize existing Hillcrest Road to be permitted by the Land Development Division.

 

18.              That the developer submit a request for an amendment to the Major Street Plan to remove existing Hillcrest Road as an arterial street.

 

19.              That the developer dedicate a minimum of 30 feet of right-of-way on the north side of 93rd Street and construct a half street improvement on the north side to collector street standards including curb and gutter, sidewalk, streetlights and storm sewers.

 

20.              That the developer relocate, extend and abandon public and private water mains as required by the Water Services Department.

 

21.              That the developer provide new easements and retire existing water easements if no longer needed.

 

22.              That the developer relocate, extend and abandon sewers as required by the Water Services Department.

 

23.              That the developer provide wider sanitary sewer easements as required by the Water Services Department sewer easement matrix.

 

24.              That the developer rehab portions of existing sanitary sewers as required by the Water Services Department.

 

25.              That the developer meet the fire flow requirements as set forth in Appendix B of the International Fire Code 2000. (IFC2000: § 508.1)

 

26.              That fire hydrant(s) are required within 400 feet on a fire access road following an approved route established by the Authority Having Jurisdiction (AHJ) of any exterior portion of a building. The use of existing fire hydrant(s) may be used to satisfy this requirement otherwise a private fire hydrant(s) or hydrant system may be required. This distance may be increased to 600 feet for R-3 occupancy(s) or if the building(s) is fully protected by an approved automatic fire sprinkler system(s). (IFC2000:§508.5.1)

 

27.              That fire hydrants shall be installed and operable prior to the arrival of any combustible building materials onto the site. (IFC2000:§1412.4; NFPA 241§ 8.7.2)

 

28.              That electric security gates, grills or other device which span across a fire access road shall be equipped with an approved operating device (IFC-2000: § 503.6).

 

29.              That the developer obtain a permit from MoDOT prior to work on state right-of-way.

 

30.              That prior to any of Phases 3 through full build-out of the development plan, the developer submit an updated traffic impact study as required by the City and MoDOT, obtain the City’s approval of said traffic impact study, construct those improvements identified in said approved traffic impact study which are determined by the Public Works Department to be the responsibility of the developer, dedicate all necessary right-of-way to accommodate said improvements, and obtain permits from MoDOT for all said improvements identified on state right-of-way, as required by Public Works Department.

 

31.              That prior to any of Phases 1 and 2, the developer construct or enter into a deferral agreement to construct at such time as determined by the Public Works Department, the following improvements including all necessary dedication of additional right-of-way, traffic signal modification and upgrade, ADA compliance, and Accessible Pedestrian Signals (APS) compliance, as required by the Public Works Department:

 

a)      At the intersection of Bannister Road and Marion Ridge, modify pavement markings, geometry, and traffic signals as necessary to eliminate split phasing for northbound and southbound traffic, as required by the Public Works Department;

 

b)      At the intersection of Bannister Road and Marion Ridge, petition the Public Works Department to provide additional green time during the P.M. peak hour for the northbound movements;

 

c)      On northbound Hillcrest Road at 87th Street, construct dual northbound left-turn lanes such that the additional lane provides at least 400 feet of storage plus appropriate taper, and modify the traffic signal phasing so as to provide a protected left-turn phase for northbound traffic;

 

d)     On eastbound 87th Street at Hillcrest Road, reconstruct the south curb line of 87th Street so as to create an eastbound right-turn lane with 300 feet of storage plus appropriate taper, as required by the Public Works Department;

 

e)      On eastbound Bannister Road at Hillcrest Road, reduce the width of the existing raised median so as to increase storage of the right-hand left-turn lane on the eastbound approach, as required by the Public Works Department;

 

f)       On southbound Hillcrest Road at Bannister Road, reconstruct the southbound approach so as to provide for one left-turn lane with 200 feet of storage plus appropriate taper, one through lane, and two right-turn lanes with 350 feet of storage for the additional lane plus appropriate taper; and

 

g)      At the intersection of Bannister Road and US-71 SB Ramps, optimize the traffic signal timings along the Bannister corridor and petition the Public Works Department to implement said optimized timings on adjacent City right-of-way, including submittal of all necessary supporting information.

 

32.              That the developer submit a Street Naming Plan to the Development Management Division prior to issuance of a building permit. The street naming plan shall be approved prior to issuance of address for this UR plan.

 

33.              That the developer grant the Kansas City Fire Department a perpetual access easement that allows full and unfettered use of Hillcrest Road by KCFD in its’ current and future alignment (including during construction) for both emergency and non-emergency use for access to E. 87th Street.

 

34.              That the developer continue to work with the KCMO Fire Department to strive towards maintaining optimum response times as it relates to the privatization of Hillcrest Road prior to construction permit for Hillcrest Road relocation.  Options to be considered include: redesign of the traffic circles, navigation of proposed security gates and possible relocation of Fire Station No. 41.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
