ORDINANCE NO. 970196

 

Approving the preliminary plat of Heritage Estates East on a 1.2 acre tract of land generally located at the northeast corner of 11th Street and Olive Street. (SD 0773)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Heritage Estates East on a 1.2 acre tract of land generally located at the northeast corner of 11th Street and Olive Street, and more specifically described as follows:

 

Lots 37 through 44, Clouser and Cole's Addition, a subdivision in Kansas City, Jackson County, Missouri, being more particularly described as follows: Beginning at the northwest corner of Lot 37, thence North 90 00'00" East along the north lines of Lots 37 through 44, 400.00 feet to the northeast corner of Lot 44; thence South 00 04'00" East, along the east line of Lot 44, 130.00 feet to the southeast corner thereof; thence North 90 00'00" West, along the south line of aforementioned lots, 400.00 feet to the southwest corner of Lot 37; thence North 00 04'00" West, 130.00 feet to the point of beginning. Contains 52,000 square feet or 1.20 acres.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the developer make any improvements as required by the City

Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to the commencement of any construction

activities.

 

4. That the developer insure that any construction and improvements of curbs, gutters and sidewalks are as required by the Independence Plaza Urban Renewal Plan.

 

5. That the developer submit a street tree planting plan with the final plats, with spacing, species and size of street trees to be approved by the City Forester.

 

6. That the developer pay money in lieu of parkland dedication in satisfaction of Section 66-128 in the amount of $930.12 for 5 single family units.

 

A copy of said preliminary plat is on file in the office of the City Clerk under Document No. 970196, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
