SECOND COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 040796

 

Approving a Community Unit Project on an approximately 19.60 acre tract of land generally located on the north side of N.E. Staley Road and approximately 900 feet east of N. Woodland Avenue. (11659-CUP-9)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 19.60 acre tract of land generally located on the north side of N.E. Staley Road and approximately 900 feet east of N. Woodland Avenue, and more specifically described as follows:

 

A tract of land in the Northeast and Southeast Quarter of Section 25, Township 52, Range 33, Kansas City, Clay County, Missouri, being described as follows: Commencing at the Southwest corner of the Northeast Quarter of said Section 25; thence North 0E3500 East, along the West line of said Northeast Quarter. 131.75 feet; thence South 89E500 East, 887.29 feet to the True Point of Beginning of the tract to be herein described; thence North 16E1736 East, 151.25 feet; thence Northerly, along a curve to the right, tangent to the last described course, having a radius of 300.00 feet, a central angle of 32E0819, an arc distance of 168.28 feet; thence North 48E2555 East, 217.36 feet; thence Northerly, along a curve to the left, tangent to the last described course, having a radius of 300.00 feet, a central angle of 14E1136, an arc distance of 74.32 feet; thence North 34E1419 East, 180.41 feet; thence South 26E3625 East, 421.29 feet; thence South 55E5404 East, 285.26 feet; thence South 61E4955 East, 430.60 feet; thence Northerly, along a curve to the left, having an initial tangent bearing of North 19E3253 East, a central angle of 04E2859, an arc distance of 80.59 feet; thence South 70E0448 East, 497.35 feet to a point on the East line of said Section 25; thence South 0E2218 West, along said East line, 531.34 feet; thence North 66E4708 West, 1603.92 feet; thence Westerly, along a curve to the right, tangent to the last described course, having a radius of 2712.00 feet, a central angle of 05E5529, an arc distance of 280.43 feet to the True Point of Beginning. Containing 19.60 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer shall cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit new or update the previously approved macro storm drainage study for the overall development to address the development amendments along with a detailed micro study for approval prior to approval of the next plat and make necessary improvements as required by the City Engineer's Office.

 

3. That the developer design and construct all interior streets to City Standards as required by the Department of Public Works, including curb & gutter, storm sewers, street lights, and sidewalks.

 

4. That the developer shall subordinate to the City all private interest in the area of any right-of-way dedication as required by the Public Works Department, and that the developer shall be responsible for all costs associated with subordination activities.

 

5. That the developer secure permits to construct or reconstruct existing sidewalks, curb, gutter, storm sewers, and street lights as necessary along all development street


frontages, as required by the Public Works Department.

 

6. That any relocated streetlights be integrated into existing street light system as required by the City Engineers Office and Missouri and Highway Transportation Department along State frontages.

 

7. That the developer submit a street name signage plan for the entire development area for approval by the Street Naming Committee prior to submittal of the first final plat.

 

8. That the developer submit plans for grading, siltation, and erosion control to the City Engineer's Office for approval and permitting prior to beginning any construction activities.

 

9. That the developer secure a site disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre. (See Third Committee Substitute for Ordinance 981135 and Ordinance 020879).

 

10. That the developer secure a land disturbance permit from Missouri Department of Natural Resources if the disturbed area for the entire development exceeds one (1) acre.

 

11. That the developer extend sanitary sewers to ensure individual service and extend storm sewers to ensure service to all proposed lots and determine adequacy as required by the Department Public Works.

 

12 That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of private open space and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

13. That the developer extend water mains as required by the Water Services Department.

 

14. That the developer pay a total of $30,080.43 (196 x 2 x .006 x $12,789.30) owed in lieu of parkland dedication.

 

15. That the developer dedicate additional right-of-way for Shoal Creek Parkway as required by the Board of Parks and Recreation Commissioners so as to provide 100 feet of right-of-way as measured from the centerline of the proposed Shoal Creek Parkway.

 

16. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right-of-way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 040796, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
