ORDINANCE NO. 991211

Directing the Director of Convention and Entertainment Centers to execute a First Amendment to a Facilities Agreement with the American Royal Association (the Association) and the Kansas City American Royal Arena Corporation (the Arena Corporation).

WHEREAS, the construction of the Scott Pavilion and the Scott Storage Area, and the prospective use thereof, requires that certain amendments be made to the Facilities Agreement between the City, the Association, and the Arena Corporation; and

WHEREAS, Ordinance No. 990406 authorized execution of an Amended and Restated Facilities Use Agreement with the Association and the Arena Corporation; and

WHEREAS, the Ground Lease and this First Amendment to Facilities Agreement are considered to be separate parts of one and the same transaction; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Director of Convention and Entertainment Centers is authorized to execute a First Amendment to Facilities Agreement with the American Royal Association and the Kansas City American Royal Arena Corporation. A copy of the amendment, in substantial form, is attached hereto and is hereby approved.
