THIRD COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 090234

 

Amending Chapter 2, Code of Ordinances, by enacting a new section regarding transfer of funds.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Chapter 2, Code of Ordinances of the City of Kansas City, Missouri, is hereby amended by enacting a new section regarding transfer of funds, to read as follows:

 

Sec. 2-1992. Transfers.

 

(a) Transfers requiring approval by ordinance. After passage of the annual appropriation ordinance, the council may by ordinance authorize the transfer of unencumbered balances between funds, from one department to another or to make new programmatic additions of $20,000.00 or more. If the city manager determines that an imminent threat to public health, welfare, safety or essential operations of the city exists, the city manager may transfer funds without prior council approval, provided that he or she provides written notice of the transfer to the mayor and council, along with the justification, as soon as possible thereafter.

 

(b) Transfers not requiring approval by ordinance. After passage of the annual appropriation ordinance:

 

(1) The City Manager may authorize and approve the transfers of unencumbered balances within a single fund and within a single department for current and ordinary department functions or for new programmatic additions less than $20,000.00.

 

(2) The Mayor may authorize the transfers of unencumbered balances within a single fund and within the Office of the Mayor for current and ordinary functions or for new programmatic additions less than $20,000.00.

 

(3) The Mayor Pro Tem may authorize and approve the transfer of unencumbered balances within a single fund within the Office of the City Council for current and ordinary functions or for new programmatic additions less than $20,000.00.

 

(c) Definitions. For the purposes of this section, the term programmatic means relating to a discrete program, project, function or type of activity. The term current and ordinary department functions means functions or activities which fall within the purpose or duties of the department or office as established by the Charter or ordinance, have been traditionally performed by the department or office, and not specifically directed to be eliminated by action of the council.

 

(d) Authorization for administrative regulation. The city manager is authorized to promulgate an administrative regulation to implement this section.

 

(e) Reporting. Within 20 days of the end of each month, the city manager shall file with the council a report listing the dates, amounts, departments involved and the purposes of the transfers made under this section during the preceding month, and the Board of Police Commissioners shall file a report with the council a report listing the dates, amounts, and purpose of the transfers made under this section.
